Dominic Nesbitt and his partner, Gary Osborne, have obtained numerous multimillion-dollar insurance recoveries on behalf of commercial policyholders. Most recently, they represented a publicly traded company in an action against its liability insurer and obtained a summary judgment ruling that the insurer breached its duty to defend by improperly relying upon an Intellectual Property Exclusion to disclaim coverage. See Align Tech. Inc. v. Federal Ins. Co., 673 F. Supp. 3d 957 (N.D. Cal. 2009).
Nesbitt initially trained as an insurance broker at Lloyd's of London before entering law school in 1982, and has practiced law exclusively in the area of insurance coverage analysis and litigation. Prior to forming Osborne & Nesbitt LLP in 1996, he was associated with Luce, Forward, Hamilton & Scripps LLP and Adams, Duque & Hazeltine. He is licensed to practice law both in California and England. Nesbitt's practice is devoted exclusively to the representation of policyholders in commercial insurance disputes.
