Major Cases
Randy Kay’s practice focuses on patent, trade secret and other intellectual property and technology disputes. Kay has testified as an expert witness on the standard of care for handling trade secret litigation and trials. Practice highlights include jury trial victories in New York and California courts, winning in the Ninth Circuit and California appellate courts, and succeeding at the International Trade Commission. Kay particularly enjoyed making a difference for a small family business in its multimillion-dollar lawsuit against a former business partner who misappropriated the plaintiff’s IP.
Professional Background
Kay is a partner in Jones Day’s Intellectual Property practice. He heads Jones Day’s global trade secret subpractice. In 2008, IP Law & Business named Kay to its inaugural list of “Top 50 Under 45” IP lawyers in the nation. Kay has been named in the Best Lawyers in America and in San Diego Super Lawyers. His most recent speaking engagements include a presentation on managing patent litigation for the San Diego chapter of the Federal Bar Association, and a program defending trade secret litigation for the Intellectual Property Owners Association’s webinar series.
Professional Affiliations
Kay’s community involvement includes serving as a lawyer representative to the Southern District of California, participating as a master of the bench in the J. Clifford Wallace chapter of the American Inns of Court, and working as an adviser to the State Bar of California Intellectual Property Section (following a three-year term as an Executive Committee member). As part of his work with the State Bar of California, Kay conceived, edited and authored the treatise, “Trade Secret Litigation and Protection in California” (second edition published in 2009).
Personal Background
Kay is married to Liza Kay, who owns a boutique residential real estate company in Carmel Valley called 92130 Realty. They have two children (Noah, 10, and Avery, 8) who attend Sage Canyon Elementary in the Del Mar School District.
