Represented, with Susan L. Oliver, property owners in a personal injury case. The plaintiff, an illegal immigrant, had been living with the permission of one of the defendant's business associates on the defendant's property when he severely injured himself in a pool dive. The plaintiff claimed that the pool was poorly maintained, and that the property was not well-lit. Mr. White and Ms. Oliver countered that the plaintiff bore significant fault because he had been drinking on the night of the incident, and that because he was living in the United States illegally, his claims of lost earnings and future lost income should not stand. The case ultimately was resolved through mediation, and the property owners paid well below nuisance value. Represented the defendant in a personal injury case. The plaintiff claimed that while driving, the defendant made an unsafe lane change causing the plaintiff to lose control, roll over, and sustain skin, back, and knee injuries. The plaintiff's initial demand was for a substantial seven-figure amount, but Mr. White achieved a favorable settlement of $265,000. Represented, with Steven G. Amundson, a law firm in a breach of fiduciary duty matter. One of the firm's former clients, whom the firm had represented as a shareholder of a corporate defendant in a securities fraud case, claimed that after the corporate defendant had gone bankrupt, the firm had overbilled him and his fellow shareholders. Mr. White and Mr. Amundson argued that the plaintiff did not have standing to seek legal fees on behalf of the corporate defendant. A jury decided in favor of the firm, and awarded it a portion of the fees it sought on a cross-complaint.
