Major Cases
Randy Kay’s practice focuses on patent, trade secret and other intellectual property and technology disputes. Kay’s recent case successes include winning summary judgment of noninfringement in a biotech patent case, obtaining dismissal of a trade secret case asserted against a semiconductor manufacturer, and winning numerous injunctions in trade secret lawsuits. Kay currently serves as lead counsel in two ITC patent infringement matters and numerous trade secret and copyright cases in the telecom, computer, biotech and food processing industries. In the past year, Kay has handled claims of more than 450 trade secrets.
Professional Background
Kay is a partner in Jones Day’s Intellectual Property practice and he heads Jones Day’s global trade secret subpractice. In June 2012, Kay addressed members of the European Parliament and the European Commission as well as heads of IP for European enterprises on how U.S. trade secret protection principles could serve as a model in the ongoing effort to harmonize European IP laws. The Daily Journal named Kay to its 2012 list of Top Intellectual Property Litigators in California. In 2008, IP Law & Business named Kay to its inaugural list of “Top 50 Under 45” IP lawyers in the nation. Kay has testified as an expert witness on the standard of care for handling trade secret litigation and trials.
Professional Affiliations
Kay’s community involvement includes serving the Southern District of California as a member of its Patent Advisory Committee and as a Lawyer Representative for the Ninth Circuit, participating as a master of the bench in the J. Clifford Wallace chapter of the American Inns of Court, and volunteering as a Director for the Legal Aid Society of San Diego. As part of his work with the State Bar of California, Kay conceived, edited and authored the treatise “Trade Secret Litigation and Protection in California” (second edition published in 2009, updated 2011).
Personal Background
Kay is married to Liza Kay, who owns a boutique residential real estate company in Carmel Valley called 92130 Realty. They have two children (Noah, 12, and Avery, 10) who aspire to win gold in the 2024 mixed doubles Olympic tennis.
