Jeffrey B. Baird is a partner at Marks, Finch, Thornton & Baird LLP. His practice focuses on construction industry clients. Baird specializes in the negotiation, drafting, and litigation of all types of construction contracts for clients of all sizes and specialties. Baird has negotiated and litigated contracts for design-build, lease-leaseback, construction management (including at-risk), cost plus, and hard bid/lump sum delivery systems, both at the prime contract and trade contract levels.
Over the past decade, Baird has negotiated terms for lease-leaseback and construction management contracts for firm clients with school districts throughout California. Baird also regularly consults with firm clients on the negotiation of specific contract forms, including AIA and ConsensusDocs, and contract specific issues (e.g. indemnity, scheduling obligations, notice, and claim provisions). Baird also regularly counsels clients regarding project disputes and claim evaluation, including subcontractor defaults, notice obligations, project closeout requirements, payment rights, administrative claim procedures, and dispute resolution options. Recently, Baird has had the opportunity to negotiate several contracts involving hundreds of millions of dollars in construction. Baird also successfully negotiated the pre-litigation resolution of delay, productivity, and extra work claims on behalf of contractors with several different local public agencies. Similarly, Baird recently represented multiple contractors on the resolution of extra work and delay claims on several federal works of improvement.
Baird’s litigation practice also includes local, state, and federal bid protests; public and private construction claims, including mechanic’s lien foreclosures, extra work claims, stop notice claims, bid enforcement, contract defaults, surety obligations, and Federal Contract Disputes Act and Miller Act claims. Baird also participates in discussion panels and presentations on legal topics involving construction matters, including recent presentations about the impact of statutory indemnity changes on construction contracts.
