Janet Gutierrez was born and raised in Chula Vista. She is the first generation in her family born in the United States. Her mother and father, Bersain Gutierrez and Laura Tellez, immigrated to the United States determined that their kids obtain college educations and pursue promising careers.
In 2005, she graduated with honors, and is a recipient of the Engelhorn Family Scholarship from the University of California, San Diego, with a bachelor’s degree in political science. In 2009, she graduated from California Western School of Law and is a recipient of the California Western Biodiversity Scholarship.
During law school, Gutierrez was a law clerk at Friestad Law Firm, Emrich & Associates, Horton Oberrecht Kirkpatrick & Martha, and Troutman Sanders (formerly known as Ross, Dixon & Bell). For Gutierrez, each clerkship focused on a different practice area, and gave her a wide knowledge base. More importantly, it prepared her for the day when she would open her own law firm.
In 2009, Gutierrez opened her own law firm, Gutierrez & Associates. Gutierrez & Associates is an interdisciplinary team, combining different disciplines to offer more solutions to today’s most pressing legal problems.
Gutierrez has an impeccable record in her community. She represents clients in Chapter 7 and Chapter 13 bankruptcy, and who are facing foreclosure and evictions. She also assists clients facing a financial hardship to explore out of court workout solutions. In one of her landmark foreclosure cases, she was successfully able to get her client’s lender to repurchase the property it erroneously foreclosed on and sold after her client was approved for a HAMP Trial Plan, and return it to her client, reinstate the loan modification, and reimburse her client for the cost of the eviction. In two separate Chapter 13 bankruptcies, she was able to prevent two lenders from cancelling the loan modifications of her clients months to a year after they had been approved.
For Gutierrez, the past two years of practice have been incredibly fulfilling. Looking forward, she is determined to become a certified specialist in bankruptcy and to welcome other associate attorneys to her firm. She also hopes to mentor other young attorneys the way her mentors — Christine and Shawn Friestad and Thomas K. Shanner — so selflessly mentor her.
Gutierrez is a member of the San Diego County Bar Association and the National Association of Consumer Bankruptcy Attorneys.
