Dwayne Stein is an associate at Wingert Grebing Brubaker & Juskie. His practice includes the defense of attorneys in professional liability actions, litigating property disputes and employment claims, and defending insurers against bad faith claims. Stein handles cases from the initial stage through trial and has tried four civil cases to verdict. He has also represented clients in both state and federal appellate courts.
Stein’s litigation experience allows him to develop comprehensive strategies for his clients from discovery and pretrial motion stages through trial and post-trial motions. Stein has dealt extensively with issues involving preservation and discovery of electronically stored information. Although he is always ready for trial, he understands not every case is suited for trial and works with his clients to ensure their needs and goals are accomplished. He has successfully mediated settlements at his client’s direction, to avoid the costs of protracted litigation.
In his professional liability practice, Stein has successfully obtained dismissal of his clients at the pretrial stage utilizing anti-SLAPP statutes and 12(b)(6) motions. In handling property disputes, Stein has dealt with issues relating to easements, homeowners association disputes, wharfage access in water-adjacent communities, premises liability and mold damages. Stein also represents business entities involving issues from formation and governance to handling litigation matters.
Stein’s litigation practice is busy, but his busiest time is when he is home, where he and wife enjoy spending every spare moment with their 8-month-old son.
Stein graduated cum laude from California Western School of Law in 2008, where he was a member of the Dean’s List, and received academic achievement awards in evidence advocacy, labor and employment law and advanced legal research. Stein also was an associate writer of the California Western Law Review/International Law Journal. Stein received his Bachelor of Arts in 2005 from the New College of Florida.
Stein is a member of the San Diego Defense Lawyers and Insurance Law Section of the San Diego County Bar Association.
