On Wednesday, the California Supreme Court refused to hear an appeal from the Surfrider Foundation in its battle to block the construction of a sewage treatment plant in the South Bay. While the ruling leaves the 4th District Court of Appeal's August decision in Surfrider v. City of San Diego intact, another lawsuit against the controversial project was filed in March by Save Our Bay Inc. and Lee Olsen, past president of the San Diego Council of Divers.
