The City of San Diego Land Development Review Division has prepared a draft Mitigated Negative Declaration for the following project and is inviting your comments regarding the adequacy of the document. Your comments must be received by February 3, 2008 to be included in the final document considered by the decision-making authorities. 1590 Coast Walk: COASTAL DEVELOPMENT PERMIT for the demolition of an existing split-level single-family residence and the construction of a new 8,469-square-foot two-story residence over a basement with an attached 781-sqaure-foot garage, pool and spa on a 21,780-square-foot site. The site is located at 1590 Coast Walk, RS-1-7 Zone within the Coastal Overlay Zone and within the La Jolla Community Plan Area. The site is bounded to the west by the Pacific Ocean and to the east by Torrey Pines Road, City and County of San Diego (Parcel 1 of Parcel Map 18446).

RESOLUTION CALLING A PUBLIC HEARING TO DETERMINE WHETHER THE PUBLIC HEALTH, SAFETY OR GENERAL WELFARE REQUIRES THE FORMATION OF SOLEDAD MOUNTAIN ROAD UNDERGROUND UTILITY DISTRICT IN THE LA JOLLA PLANNING AREA.

WHEREAS, Chapter VI, Article 1, Division 5 of the San Diego Municipal Code establishes a procedure for the creation of underground utility districts and requires in such procedure the holding of a public hearing to determine whether the public health, safety or general welfare requires removal of poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electric, communication, community antenna television or similar or associated service in any such district; and WHEREAS, Council Policy 600-8, “Underground Conversion of Utility Lines by Utility Company” defines the Council Policy for undergrounding utilities; and WHEREAS, in accordance with Chapter VI, Article 1, Division 5 of the San Diego Municipal Code and Council Policy 600-8, it has been recommended that the following underground utility district [District] be formed:
a. Lots 194 through 202 & 203 through 213 of Map of Soledad Corona Estates Unit No.3 Subdivision Map No. 4473.
b. Lots 1 through 10& 36 through 43 of Map of La Jolla Pacifica Unit No.1 Subdivision Map No. 4787.
c. Soledad Mountain Rd. between a line from the Northeastern corner of 5758 Soledad Mountain Rd. and to the Northwestern corner of 5755 Soledad Mountain Rd. to a line from the Southeastern corner of 5580 Soledad Mountain Rd. and to the Southwestern corner of 5783 Soledad Mountain Rd;
WHEREAS, Exhibit Attachment A, Map, and Exhibit Attachment B, Legal Description, depicts the above District which are on file in the Office of the City Clerk with greater specificity; NOW, THEREFORE,
BE IT RESOLVED, by the City Council of the City of San Diego, as follows:
1. Notice is hereby given that a public hearing will be held by the Council of the City of San Diego on January 29, 2008, at the hour of 2:00 p.m. in the Council Chambers of the City Administration Building, 202 C Street, San Diego, California, to determine whether the public health, safety or general welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, community antenna television or similar or associated service in the District described above.
2. At such hearing all persons interested shall be given an opportunity to be heard and said hearing may be continued from time to time as may be determined by the City Council. The decision of the City Council as to the formation of the District as described above shall be final and conclusive.
3. The City Clerk shall notify all affected persons as defined in Chapter VI, Article 1, Division 5 of the San Diego Municipal Code and each utility company concerned of the time and place of the hearing by following the procedure set forth in Chapter VI, Article 1, Division 5 of the San Diego Municipal Code.
4. The Annual Allocation-Undergrounding of Utilities, project allocation for 2007 Calendar Year, is amended by removing the projects known as Sunset Cliffs Blvd (Coronado Ave to Newport Ave) and Fanuel Street (Grand to Reed) estimated at $1,587,844, and replacing with Soledad Mountain Road (Pacifica to Ridgegate Row) at an estimated cost of $2,337,695.
BE IT FURTHER RESOLVED, that this activity is categorically exempt from CEQA, pursuant to State CEQA Guidelines Section 15302(d), and Public Utilities Commission General Order 131-D, dated August 11, 1995.
Passed by the Council of The City of San Diego on January 7, 2008, by the following vote.
