AN ORDINANCE AUTHORIZING ASSIGNMENTS OF FOUR (4)
AVIGATION
EASEMENTS TO THE SAN DIEGO COUNTY
REGIONAL AIRPORT AUTHORITY

WHEREAS, the San Diego Unified Port District, a public corporation, (District) has been the owner and operator of San Diego International Airport, Lindbergh Field, (Airport) since 1963, pursuant to Stats. 1962, 1st Ex. Sess., c.67, as amended; and
WHEREAS, pursuant to Assembly Bill 93 (AB 93) (Stats. 2001, c. 946), the San Diego County Regional Airport Authority (Authority) was established as a local entity of regional government with jurisdiction throughout the County of San Diego, and said Authority is required to adopt a comprehensive airport land use plan for said County and coordinate airport planning of public agencies; and
WHEREAS, said AB 93 requires the District to transfer the Airport to said Authority; and
WHEREAS, pursuant to Senate Bill 1896 (SB 1896) (Stats. 2002, c. 978), which amends said AB 93, the provisions governing the transfer of real and personal property by the District to the Authority, including specifically described real properties that are not to be transferred and specifically described real properties that are to be transferred, were recast; and
WHEREAS, the District desires to assign, transfer and set over unto said Authority, any and all rights held by the District in Four (4) Avigation Easements which overlie certain described real property located in the City of San Diego, County of San Diego, State of California, NOW, THEREFORE,
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. That the Executive Director or his authorized representative is hereby authorized and directed to execute, on behalf of the District, Four (4) Assignment of Avigation Easements with each of the parties listed on the document entitled "Avigation Easements Being Assigned from San Diego Unified Port District to San Diego County Regional Airport Authority", attached hereto as Exhibit A and by this reference made a part hereof, on or after January 1, 2003. Said Exhibit A reflects the Address of the property involved, the Name of the Grantor, the Date of the Avigation Easement and the District Document Number thereof. Four (4) separate Assignment of Avigation Easement documents shall be placed on file in the office of the District Clerk.
Section 2. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE AUTHORIZING ASSIGNMENT AND
ASSUMPTION OF TWO (2)
MISCELLANEOUS AGREEMENTS TO THE SAN DIEGO
COUNTY REGIONAL AIRPORT AUTHORITY

WHEREAS, the San Diego Unified Port District, a public corporation, (District) has been the owner and operator of San Diego International Airport, Lindbergh Field, (Airport) since 1963, pursuant to Stats. 1962, 1st Ex. Sess., c.67, as amended; and

WHEREAS, the District desires to assign, transfer and set over unto said Authority, all of the District's right, title and interest in Two (2) Miscellaneous Agreements, including but not limited to an Agreement with the City of San Diego concerning the Reuse Recommendations for Camp Nimitz (which Agreement requires the consent of the City of San Diego), and an Encroachment Permit with the San Diego Unified School District of San Diego, California, for properties located in the City of San Diego, County of San Diego, State of California, NOW, THEREFORE
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. That the Executive Director or his authorized representative is hereby authorized and directed to execute, on behalf of the District, Assignment and Assumption documents, which provide for the District to assign, transfer and set over unto the Authority all of the District's right, title and interest in and to said miscellaneous agreements, on or after January 1, 2003, described on Exhibit A, entitled "Miscellaneous Agreements Being Assigned from San Diego Unified Port District to San Diego County Regional Airport Authority", attached hereto and by this reference made a part hereof. Said Exhibit A reflects the name of the Party to the Agreement, the Type of Agreement, the Date of the Agreement, and the District Document Numbers thereof. Two (2) separate Assignment and Assumption documents shall be placed on file in the office of the District Clerk.
Section 2. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

ORDINANCE 2237
AN ORDINANCE ESTABLISHING PARKING RATES FOR
SHELTER ISLAND'S SPORTFISHING PARKING LOTS

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. That the rates for Shelter Island's Sportfishing Parking Lot (Main Parking Lot), located on Scott Street, near Harbor Drive, in the City of San Diego, shall be as follows:
a.?Free for the first half hour or any part thereof;
? b.?One Dollar ($1.00) per hour or any part thereof for each hour commencing after the first said half hour, or a maximum of Five Dollars ($5.00) for each Twenty Four (24) hour period or any part thereof.
Section 2. That the rates for Shelter Island's Sportfishing Parking Lot (Westy's Lot), located on North Harbor Drive, near Scott Street, in the City of San Diego, shall be as follows:
a.?Five Dollars ($5.00) per each Twenty Four (24) hour period or any part thereof.
Section 3.?That the Executive Director may use the rates established pursuant to this Ordinance for new or extended Operating Agreements for said Parking Lots.
Section 4.?This ordinance and the rates herein shall take effect on the 31st day from its passage by the Board of Port Commissioners, and said rates shall be posted. Upon said rates becoming effective, Ordinance 1367 entitled "An Ordinance Establishing Parking Rates for Shelter Island's Sportfishing Parking Lots" is hereby repealed.

Notice is hereby given that the Purchasing Department, First Floor of San Diego Unified Port District will receive sealed bids at 3165 Pacific Highway, San Diego, California, until 2:00 P.M. on the 14TH day of February, 2003 for:

WAY FINDING SIGNAGE
SAN DIEGO, CALIFORNIA

The work includes furnishing and installing way finding signage which consist of vehicular and pedestrian directional signage and banners mounted on galvanized steel poles and pedestrian base supports; demolition, excavation, removal and disposal of excavated materials; repair and construction of surface pavement, and other incidental related items of work.
The work is located on Pacific Highway, North Harbor Drive, Broadway, Ash Street, Kettner Boulevard and Hawthorne Street, in San Diego, California.
The magnitude of this work is in the range of $50,000.00 - $100,000.00
Bids will be opened in public at or about that hour at 3165 Pacific Highway, San Diego, California, all as more particularly contained in Document No. 44972 on file in the office of the Clerk of the District. No Bidder may withdraw a bid within sixty (60) days after the date set for the opening of bids.
Plans and specification will be available on January 15, 2003 at no cost, during the hours of 8:30 a.m. to 11:30 and 1:30 p.m. to 4:00 p.m. Monday through Friday, excluding District holidays, from the Purchasing Department, San Diego Unified Port District, P.O. Box 120488, San Diego, CA 92112-0488, or picked up in person at 3165 Pacific Highway, San Diego, California, Telephone Number (619) 686-6320. Shipment of plans and specifications by Federal Express is available at Bidder?s expense. The purchase price and cost of shipment are not refundable. One set of plans and specifications will be made available by the District to local plan file services.
In accordance with the provisions of the California State Labor Code, the District has obtained the general prevailing rate of wages (which rate includes employer payments for health and welfare, vacation, pension and similar purposes) applicable to the work to be done, for straight time, overtime, Saturday, Sunday and holiday work. All labor employed on this project shall be paid no less than such minimum rates of wages. These wage rates are available for inspection at the office of the Assistant Director of Engineering ? Design, San Diego Unified Port District.
It is the policy of the San Diego Unified Port District that certified Disadvantaged Business Enterprises (DBEs) shall have the maximum opportunity to participate in the performance of District Contract. Certified DBEs with qualifying experience are encouraged to respond to the request for proposals/bids/quotes, etc.
Bidder shall file a payment bond as required by the Contract and Civil Code section 3247. The provisions of Public Contract Code section 22300 apply to this Contract.
Bidders are hereby notified that the successful Bidder will be required to provide insurance in an amount and type(s) as required by the contract.
A Notification Regarding Environmental Conditions has been included as Exhibit A in the project specifications. This notification will serve as the District?s disclosure regarding potential hazardous materials which may be encountered during grading, excavation, trenching, and/or other ground penetration.
In the public interest, the District reserves the right to reject any or all bids, or to waive any informality in a bid.
