NOTICE OF INTENTION TO SELL REAL PROPERTY AT PRIVATE SALE
SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF

Notice is hereby given that, subject to confirmation by this court, on January 18, 2005 at 1:00 p.m., or thereafter within the time allowed by law, the executor of the estate of the above-named decedent, will sell at private sale to the highest and best net bidder on the terms and conditions hereinafter mentioned all right, title, and interest of the Estate of Laura Merle Breise in the real property located at 3428 Garrison Street, San Diego, California, 92106.
The sale is subject to current taxes, covenants, conditions, restrictions, reservations, rights, rights of way, and easements of record, with any encumbrances of record to be satisfied from the purchase price.
The property is to be sold on an "as is" basis, in its present condition as of the date of acceptance of a bid or offer, unless otherwise agreed in writing.
Bids or offers are invited for this property and must be in writing and will be received at the office of Dean Eades, the listing broker, at Century 21 - 1st Choice Pacific, 845 Garnet Avenue, San Diego, California, 92109, or delivered to Dean Eades personally, at any time after the first publication of this notice and before any sale is made.
The property will be sold on the following terms: All cash, 10 percent of the amount of the bid to accompany the offer by certified check, and the balance to be paid upon close of escrow after confirmation of sale by the court. Property shall be vacant at least five days prior to close of escrow, unless otherwise agreed in writing between buyer and seller.
The Executor reserves the right to refuse to accept any bids.
