As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer of Centre City Development Corporation (CCDC) will hold a hearing to approve, conditionally approve or deny an application by Parking Company of America for an Amendment to Conditional Use Permit (CUP) (PROCESS THREE) No. 2009-03 to allow the continued operations of a 129-space surface parking lot located at 428 Eighth Avenue in the East Village Neighborhood of the Downtown Community Plan Area.
The decision of the CCDC Hearing Officer is final unless appealed to the CCDC Board of Directors. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained at the CCDC Planning Department, 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10)
business days of the Hearing Officer's decision. If the Hearing Officer decision is appealed, the decision made by the CCDC Board of Directors is the final decision.
The project is categorically exempt from the California Environmental Quality Act (CEQA) under State CEQA Guidelines Section 15303 (New Construction or Conversion of Small Structures) and Section 15304 (Minor Alterations to Land). Section 15303 applies to a class of projects that consists of construction and location of limited new small facilities or structures, installation of small new equipment, installation of utility connections and street improvements. Section 15304 applies to a class of projects that consists of minor public or private alterations in the condition of land, and includes minor grading and filling activities, trenching and backfilling, and minor temporary uses of land. This project consists of an existing surface parking lot that includes the addition of trees, irrigation and fence. The application of the Class 3 and Class 4 Categorical exemptions are, therefore, appropriate in this case. The application of a Categorical Exemption to this project is not precluded by any of the exceptions set forth in State CEQA Guidelines Section 15300.2.
