AN ORDINANCE AMENDING ANNUAL BUDGET FOR FISCAL YEAR 2009-2010
 

WHEREAS, on 9 June 2009, pursuant to Ordinance 2567, the Board of Port Commissioners (Board) of the San Diego Unified Port District (District) adopted the Annual Budget for the operation of the District for Fiscal Year 2009-2010, said budget is on file in the office of the District Clerk as Document No. 55124; and
  WHEREAS, in order to comply with new accounting standards issued by the Governmental Standards Accounting Board, the District desires to amend said Annual Budget to transfer costs in the amount of Twelve Million Ninety Four Thousand Eight Hundred Dollars ($12,094,800.00) for the TDY Building Demolition and Abatement Project from the Ordinary Annual Expenses portion of said Budget to the Capital Major Maintenance portion; and
  WHEREAS, in order to comply with new accounting standards issued by said Governmental Standards Accounting Board, the District further desires to provide for the full cost of the Annual Required Contribution for Other Post Employment Benefits, Four Million Five Hundred Twenty Five Thousand Three Hundred Dollars ($4,525,300.00), NOW, THEREFORE,
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. That the Annual Budget for Fiscal Year 2009-2010 is hereby amended by decreasing the amount of funds previously appropriated for Ordinary Annual Expenses by Seven Million Five Hundred Sixty Nine Thousand Five Hundred Dollars  ($7,569,500.00), and further by increasing the amount of funds previously appropriated for Capital Major Maintenance by Twelve Million Ninety Four Thousand Eight Hundred Dollars ($12,094,800.00), as follows:

 Section 2.   This ordinance is declared to take effect upon its publication, pursuant to the provisions of Section 21 of the San Diego Unified Port District Act.

AN ORDINANCE GRANTING A LEASE TO SAN DIEGO GAS & ELECTRIC
COMPANY

 
  WHEREAS, pursuant to Resolution 2010-11, adopted 5 January 2010, the Board of Port Commissioners (Board) of the San Diego Unified Port District (District) authorized and directed the Executive Director of the District or his authorized representative to execute a Real Estate Exchange Agreement and Joint Escrow Instructions (Agreement) between the San Diego Unified Port District, a public corporation, and San Diego Gas & Electric Company, a California corporation, for the District's transfer of approximately 12.42 acres to San Diego Gas & Electric Company (SDG&E), and SDG&E's transfer of their interest in approximately 7.22 acres and approximately 10.47 acres to the District, said property located in the City of Chula Vista; and
  WHEREAS, pursuant to said Resolution 2010-11, the Board further authorized and directed the Executive Director to execute Escrow Instructions and other necessary documents related to said property exchange, including any Certificates of Acceptance; and
  WHEREAS, pursuant to Resolution 2010-12, adopted 5 January 2010, the Board further authorized and directed the Executive Director or his authorized representative to execute an Agreement for the Exchange of Lands in the City of Chula Vista Between the California State Lands Commission, the San Diego Unified Port District and San Diego Gas & Electric Company, said Agreement for the Exchange of Lands to be in substantially the form presented to and considered at the meeting of the Board of Port Commissioners held on 5 January 2010; and
  WHEREAS, the District and SDG&E desire to enter into a lease agreement for approximately 7.22 acres of land located north of the South Bay Power Plant and west of Bay Boulevard in the proposed Otay District of the Chula Vista Bayfront, NOW, THEREFORE,
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. That lease agreement between the San Diego Unified Port District and San Diego Gas & Electric Company, a California corporation, on file in the office of the District Clerk, leasing certain premises located north of the South Bay Power Plant and west of Bay Boulevard in the proposed Otay District of the Chula Vista Bayfront in the City of Chula Vista, for the use, operation, maintenance, repair and removal of an existing substation, utility equipment storage required to operate and maintain said existing substation and related uses and for no other purpose whatsoever, is hereby approved and granted.
  Section 2. The Executive Director or his authorized representative is hereby directed to execute the said lease agreement with San Diego Gas & Electric Company on behalf of the District.
  Section 3. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.
