As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer of Civic San Diego (“CivicSD”) will hold a hearing to either approve, conditionally approve, or deny an application for an amendment to Conditional Use Permit (CUP) No. 2008-39 (Process Three) to allow the sale of alcoholic beverages for on- and off-site consumption at Stone Tap Room, a proposed restaurant and brewery tasting room, to be located at 795 J Street in the East Village Neighborhood of the Downtown Community Plan (DCP) Area. The Applicant is seeking an exception to the standard condition for the off-site sale of alcoholic beverages that includes the elimination of the 25 percent quarterly gross-sales restriction.
The decision of the CivicSD Hearing Officer is final unless appealed to the CivicSD Board of Directors. In order to appeal the decision you must be present at the public hearing and file a speaker's slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained from the CivicSD Office located at 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10)
business days of the Hearing Officer's decision. If the Hearing Officer's decision is appealed, the decision made by the CivicSD Board of Directors is the final decision.
This activity is covered under the Final Environmental Impact Report (FEIR) for the San Diego DCP, Centre City Planned District Ordinance, and 10th Amendment to the Centre City Redevelopment Plan, certified by the certified by the City Council and the former Redevelopment Agency (“Former Agency”) on March 14, 2006 (Resolution R-301265 and R-04001, respectively) and subsequent addenda to the FEIR. The FEIR is a “Program EIR” prepared in compliance with California Environmental Quality Act (CEQA) Guidelines Section 15168. CivicSD staff has concluded that the proposed activity of the development of a restaurant and brewery tasting room at an existing tenant space with the ability to sell alcoholic beverages for on- and off-site consumption, including some interior tenant improvements, is within the scope of the development program described in the FEIR and that the environmental impacts were adequately addressed in the FEIR; therefore, no further environmental documentation is required under CEQA.
If you wish to challenge either CivicSD's or the City of San Diego's action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written correspondence to CivicSD at or before the public hearing.
