SUBJECT: PACIFICA COMPANIES MIRA MESA HOTEL: APPROVAL OF AN AMENDMENT TO PLANNED COMMERCIAL DEVELOPMENT PERMIT (LDR PCD No. 96-7485) to allow a 4-story, 45,000 square feet, 74-room hotel on a 2.8-acre site at the northeast corner of the intersection of Mira Mesa Boulevard and Lusk Boulevard. The proposal is an amendment to previously approved PCD No. 86-0741 which allowed a 8,000 s.f. restaurant on the site; the proposed hotel would replace this approved (unbuilt) restaurant. Applicant: Escondido Ventures, Inc.
This recommended finding that the proposed project as designed/mitigated will not have a significant effect on the environment effect is based on an Environmental Initial Study conducted by the City of San Diego. An amendment to the Municipal Code relating to residential care facilities, emergency shelters and transitional housing is required to implement changes resulting from the previously approved Housing Element Amendment. This ordinance amends the San Diego Municipal Code Chapter X, Article 1, Division 4, by making changes to the biological resource protection regulations to implement the Multiple Species Conservation Plan.
The effective date of this ordinance shall be thirty days after adoption of this ordinance. Sections 101.0462 and 101.0462.0001 through 101.0462.0029 will stay in effect until they are repealed pursuant to Section 5 of Ordinance No. O-18451, adopted on December 9, 1997. This ordinance will not apply within the Coastal Zone until the thirtieth day following the date the California Coastal Commission unconditionally certifies this ordinance as a local coastal program amendment.

RESOLUTION CALLING FOR A PUBLIC HEARING TO DETERMINE WHETHER THE PUBLIC HEALTH, SAFETY, OR GENERAL WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT TO BE KNOWN AND DENOMINATED AS THE CCDC AREA 1 - PHASE 1, MARKET STREET TO K STREET (6TH AVENUE TO 12TH AVENUE) UNDERGROUND UTILITY DISTRICT.
WHEREAS, Chapter VI, Article 1, Division 5 of the San Diego Municipal Code establishes a procedure for the creation of underground utility districts and requires as an initial step in such procedure the holding of a public hearing to determine whether the public health, safety, or general welfare requires removal of poles, overhead wires, and associated structures and the underground installation of wires and facilities for supplying electric, communication, community antenna television or similar or associated service in any such district; and
WHEREAS, it has been recommended that such an underground utility district, hereinafter called "the District," be formed as more particularly shown on Drawing No. 28766-D, entitled "CCDC AREA 1 - PHASE 1, MARKET STREET TO K STREET (6TH AVENUE TO 12TH AVENUE) UNDERGROUND UTILITY DISTRICT," copies of which are on file in the office of the City Clerk as Document No. RR-289615; and
WHEREAS, this action is exempt from the provisions of the California Environmental Quality Act of 1970 under City guidelines for implementation of said Act, as amended; NOW, THEREFORE,
BE IT RESOLVED, by the Council of the City of San Diego, as follows:
1. Notice is hereby given that a public hearing will be held by the Council of The City of San Diego on February 17, 1998, at the hour of 10:00 a.m. in the Council Chambers of the City Administration Building, 202 C Street, San Diego, California, to determine whether the public health, safety, or general welfare requires the removal of poles, overhead wires, and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, community antenna television or similar or associated service in the District described above.
2. At such hearing all persons interested shall be given an opportunity to be heard and the hearing may be continued from time to time as may be determined by the City Council. The decision of the City Council as to the formation of the District as described above shall be final and conclusive.
3. The City Clerk shall notify all affected persons as defined in Chapter VI, Article 1, Division 5 of the San Diego Municipal Code and each utility company concerned of the time and place of the hearing by following the procedure set forth in Chapter VI, Article 1, Division 5 of the San Diego Municipal Code.
