IN THE UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF CALIFORNIA IN ADMIRALTY CASE NO. 02 CV 1957 IEG NOTICE OF ARREST DRISCOLL, INC., a California corporation, dba DRISCOLL BOAT WORKS, Plaintiff, vs. M/Y FULL CIRCLE, U.S.C.G., Official Number 958224, nd all of her engines, tackle, accessories, equipment, furnishings and appurtenances, in rem; and DC HOLDING, INC., a Delaware corporation and KEN MITAN and CHIP MAC PEARSON, in personam, Defendants. DEBIS FINANCIAL SERVICES, INC., a Delaware corporation, Plaintiff-in-Intervention, vs. M/Y FULL CIRCLE, Official Number 732842, Registered in George Town, Cayman Islands, and all of her engines, tackle, accessories, equipment, furnishings and appurtenances, in rem; STAR MARINE HOLDINGS, INC., a company incorporated and existing under the laws of the Cayman Islands; in personam, Defendants-in-Intervention. In obedience to a Warrant for Arrest directed to the United States Marshal for the Southern District of California in the above-entitled cause, I have, on the 22nd day of January, 2003, served a warrant of arrest on the following described defendant, the vessel M/Y FULL CIRCLE, Official No. 732842, all her engines, tackle, accessories, equipment, furnishings and appurtenances, in rem; (the "Vessel"), for the causes set forth in the complaint-in-intervention, to with foreclosure of maritime liens, now pending in the United States District Court this district.
I HEREBY GIVE NOTICE that, pursuant to Rule C(6) of the Federal ? of the civil Procedure, claims of persons entitled to possession of said Vessel and all her engines, tackle, acessories, equipment, furnishings and appurtenances etc., must file their claims with the Clerk of the Court within ten(10) days after execution of this process and serve their answers within twenty(20) days after filing of their claim, and that as to any person or entity not so serving and filing his claim and answer, default will be noted and condemnation ordered, and, further, that applications for intervention in accordance with Rule 24 of the Federal Rules of Civil Procedure by persons claiming maritime liens or other interests must be filed within thirty(30) days after publication of this Notice of Arrest and copies thereof served upon attorneys for plaintiff-in-intervention, and that, as to all persons and entities not so filing such applications for intervention within the time limits set out above, default will be taken.
