The SAN DIEGO ASSOCIATION OF GOVERNMENTS (SANDAG), 401 B Street, Suite 800, San Diego, CA 92101-4231, is requesting bids to perform the work, in general, as follows.
  Furnishing and installing overhead and underground railroad signaling and fiber optic cables.  New aerial railroad signal and fiber optic cables will be lashed to new 3/8-inch extra high strength galvanized steel strand wire attached to catenary poles. Underground cables will be pulled through new and existing PVC and HDPE ducts. There is a base bid and additive alternate. The engineer’s estimate for both base and alternate combined is $7,290,920.
  This project is funded in part with FTA funding and in part with ARRA funding. It is race neutral; there is no DBE nor UDBE goal on this project.
  A prebid meeting will be held on Wednesday, February 3, 2010, at 2:30 p.m. at the offices of Kimley-Horn, 401 B Street, 6th Floor, Wells Fargo Building (same building as SANDAG).   The IFB package may be purchased only at SANDAG. It will be available for purchase by January 27 (check www.sandag.org/contracts if you plan to come in person to by it). Mail in your check to SANDAG, Attn: Louise Torio, 401 B Street, Suite 800, San Diego, CA 92101-4231. The cost is $35 for the printed spec book and bid package, with plans and reports on CD. IFB packages are NOT refundable. Make your check payable to SANDAG (credit cards and cash are NOT accepted). Include your firm’s FedEx account number against which shipment is to be arranged. Ask for the Aerial Signaling and Fiber Optic Installation Project (CIP 1210001). IFB packages may be reviewed at SANDAG and/or the Contracting Opportunities Center (619?285?7020) located at 4007 Camino Del Rio South, Suite 210, San Diego, CA. Please register your firm in SANDAG’s online contractor database to view details (see www.sandag.org/contracts for info).
  Bids must be received by 2:30 p.m., on Tuesday, March 9, 2010, at SANDAG, on the 7th Floor, attention: Louise Torio. Bids arriving later than 2:30 p.m., or at a location other than 401 B Street, 7th Floor, will not be considered.

AUTHORIZING THE LEVY OF SPECIAL TAXES
IN IMPROVEMENT AREA NO. 1 OF
COMMUNITY FACILITIES DISTRICT NO. 2

WHEREAS
, the Board of Education (the “Board of Education”) of the Poway Unified School District, California, has initiated proceedings, held a public hearing, conducted an election, and received favorable votes from the qualified electors authorizing the levy of special taxes in an improvement area of an existing community facilities district, all as authorized pursuant to the terms and provisions of the “Mello-Roos Community Facilities Act of 1982,” being Chapter 2.5, Part 1. Division 2, Title 5 of the Government Code of the State of California (the “Act”). This Community Facilities District is designated as Community Facilities District No. 2 (the “CFD No. 2”) and the improvement area is designated as Improvement Area No. 1.
THE BOARD OF EDUCATION OF THE POWAY UNIFIED SCHOOL DISTRICT, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF COMMUNITY FACILITIES DISTRICT NO. 2, DOES HEREBY ORDAIN AS FOLLOWS:
1. This Board of Education does, by the passage of this ordinance, authorize the levy of special taxes pursuant to the Rate and Method of Apportionment of Special Taxes as set forth in Exhibit “A” attached hereto (“Improvement Area No. 1 Rate and Method”) and incorporated herein by this reference.
2. This Board of Education, acting as the legislative body of CFD No. 2, is hereby further authorized, by Resolution, to annually determine the special taxes to be levied within Improvement Area No. 1 for the then current tax year or future tax years, except that the special taxes to be levied shall not exceed the maximum special tax calculated pursuant to the Improvement Area No. 1 Rate and Method, but the special tax may be levied at a lower rate.
3. The special taxes herein authorized, to the extent possible, shall be collected in the same manner as ad valorem property taxes and shall be subject to the same penalties, procedure, sale, and lien priority in any case of delinquency as applicable for ad valorem taxes; provided, however, CFD No. 2 may utilize a direct billing procedure for any special taxes that cannot be collected on the County tax roll or may, by resolution, elect to collect the special taxes at a different time or in a different manner if necessary to meet its financial obligations.
4. The special taxes shall be secured by the lien imposed pursuant to Sections 3114.5 and 3115.5 of the Streets and Highways Code of the State of California, which lien shall be a continuing lien and shall secure each levy of the special tax. The lien of each special tax shall continue in force and effect until such special tax obligation is prepaid, permanently satisfied and canceled in accordance with Section 53344 of the Government Code of the State of California or until such special tax ceases to be levied by the Board of Education in the manner provided in Section 53330.5 of said Government Code.
5. This Ordinance shall be effective thirty (30) days after its adoption. Within fifteen (15) days after its adoption, the Secretary shall cause this Ordinance to be published in a newspaper of general circulation in the School District pursuant to the provisions of Government Code Section 36933.
