NOTICE IS HEREBY GIVEN that the City of San Diego will receive bids for work at the Purchasing and Contracting Department, Contracts Division, 1200 Third Avenue, Suite 200, San Diego, California, where bids are to be submitted prior to time specified.  Plans and specifications can be obtained from The City of San Diego’s website: http://www.sandiego.gov/bids-contracts. A pre-bid meeting and/or pre-bid visit to the work site will be held, if indicated, at the time and place specified in the contract documents.  Prospective bidders are encouraged to attend these sessions.

This ordinance establishes the Community Reinvestment Review Advisory Committee to review Community Reinvestment Plans and annual reports submitted by financial institutions wishing to provide banking services to the City and to make recommendations to the Mayor and City Treasurer on financial institutions for banking services.

This ordinance amends provisions of the San Diego Municipal Code (SDMC) relating to procedures for impounded vehicles, including notice requirements and post-storage hearings. This ordinance describes those persons in the City authorized to remove vehicles, and the duties of the City to provide notice and an opportunity for a hearing, and the conduct and costs of those hearings. This ordinance is intended to conform the SDMC to the requirements of the California Vehicle Code.

This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its passage, since a written or printed copy will be available to the City Council and the public prior to the day of its passage.

AN ORDINANCE AMENDING CHAPTER 5, ARTICLE 4, DIVISION 3 OF THE
SAN DIEGO MUNICIPAL CODE BY AMENDING THE TITLE OF DIVISION 3; BY AMENDING SECTIONS 54.0301, 54.0302, 54.0303, AND 54.0304; BY AMENDING SECTIONS 54.0306, 54.0307, AND 54.0308; BY AMENDING SECTIONS 54.0310, 54.0311, 54.0312, 54.0313, 54.0314, 54.0315, 54.0316, 54.0317, 54.0318, AND 54.0319; BY AMENDING THE TITLE OF SECTION 54.0320; AND BY AMENDING SECTION 54.0321, ALL RELATING TO THE ABATEMENT AND REHABILITATION OF ABANDONED PROPERTIES.

This ordinance amends Chapter 5, Article 4, Division 3 of the San Diego Municipal Code to expand the present Vacant Structure Ordinance and establish a comprehensive definition of abandoned properties which includes properties upon which one or more of the following conditions exist: (1) a vacant lot on which code or public nuisance violations exist; (2) a vacant structure and code or public nuisance violations exist on the property; (3) a vacant structure which is boarded, irrespective of whether code or public nuisance violations exist at the property; (4) a vacant structure, and the property is under a current Notice of Default, Notice of a Trustee's Sale, pending Tax Assessor's Lien Sale, or has been the subject of a foreclosure sale. A “vacant structure” is defined as any structure or building that is unoccupied or occupied by unauthorized persons. The ordinance classifies all abandoned properties where code or public nuisance violations exist to be nuisances per se. It also subjects all abandoned properties to existing municipal code regulations relating to vacant structures, such as the requirement that a “Statement of Intent” form be filed annually so as to provide the City with information regarding the expected period of vacancy, a maintenance plan, a timeline for rehabilitation and complete ownership and contact information. Failure to make a good faith diligent effort to implement the actions set forth in the Statement of Intent or to rehabilitate, sell or lease the property may result in the imposition of an abatement penalty. Existing property maintenance requirements are expanded and new requirements added to assist the police and code inspectors in monitoring the property and responding to nuisance activity, such as posting a sign and filing a Letter of Agency for trespass violations.

Finally, this ordinance makes non-substantive changes to conform the formatting to current, standard San Diego Municipal Code conventions and to make the subsections more consistent with one another.
