The City of San Diego Engineering and Capital Projects Department, in accordance with the National Flood Insurance Program regulation 65.7 (b)(1), hereby gives notice of the City's intent to revise the Encanto Branch of South Las Chollas Creek Channel floodway, generally located near Euclid Avenue and Market Street. Specifically, the floodway shall be revised from the Euclid Avenue Bridge to approximately 850 feet upstream of the Euclid Avenue Bridge. As a result of the floodway revision, the floodway shall widen and narrow with a maximum widening of 50 feet at a point approximately 480 feet upstream of the Euclid Avenue Bridge and a maximum narrowing of 20 feet at a point approximately 800 feet upstream of the Euclid Avenue Bridge.

As a property owner, tenant, or person who has requested notice, you should know that the Planning Commission will hold a public hearing to recommend approval, conditional approval, or denial to the City Council of an application for Process 5 amendments to the Municipal Code (Chapter 14, Article 4, Division 5 of the Land Development Code) and the Local Coastal Program to allow condominium conversions to receive final map prior to making all required improvements.

The amendment to the Condominium Conversion Regulations would continue to require specified improvements related to health and safety, landscape, and parking be made prior to final map. However, improvements required by the building conditions report could be forestalled provided the applicant provides assurance that all required improvements will be made prior to the sale of the first condominium unit.

The decision to approve, conditionally approve, modify or deny the amendments to the Condominium Conversion Regulations will be made by the City Council at a future public hearing. A separate notice of public hearing will be provided 10 business days prior to the City Council hearing for this item.

The amendments to the Land Development Code and Local Coastal Program Amendment would apply to the Coastal Zone; therefore the City Council's decision requires amending the City's Local Coastal Program. As a result, the final decision on the amendments to the Land Development Code and associated Local Coastal Program amendments will be made by the California Coastal Commission. The City of San Diego must submit the amendments to the Land Development Code as an amendment for certification to the Coastal Commission. The ordinance will not be effective in the Coastal Zone until the Coastal Commission unconditionally certifies the amendment.
