AN ORDINANCE AMENDING LEASE AGREEMENT BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND CITY OF CORONADO
 
 The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
 Section 1.   That lease agreement dated 16 September 1997 between the San Diego Unified Port District and the City of Coronado, a municipal corporation, for property located at 2000 Visalia Row, commonly known as the Coronado Golf Course, is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No. 2, on file in the office of the District Clerk.
 Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE RESCINDING ORDINANCES 2497 AND 2498 REGARDING SPINNAKER WATERFRONT HOTEL, LLC
 
  WHEREAS, the San Diego Unified Port District (District) and Fifth Avenue Landing, LLC, a California limited liability company, are parties to a Lease dated 9 October 1984, as assigned and amended, for premises located bayward of Convention Way and Marina Park Way in the City of San Diego, said Lease is on file in the office of the District Clerk as Document No. 17439; and
  WHEREAS, the District and Fifth Avenue Landing, LLC, a California limited liability company, are parties to an Option Agreement dated 7 October 2003, as amended, for premises located bayward of Convention Way and Marina Park Way in the City of San Diego, said lease is on file in the office of the District Clerk as Document No. 46578; and
  WHEREAS, Fifth Avenue Landing, LLC desired to assign said Lease and Option Agreement to Spinnaker Waterfront Hotel, LLC, and requested the District's consent thereto; and
  WHEREAS, Fifth Avenue Landing, LLC and Spinnaker Waterfront Hotel, LLC
entered into a Purchase and Sale Agreement and opened an escrow account; and
WHEREAS, pursuant to Ordinance 2497, adopted 6 May 2008, the Board of Port Commissioners (Board) of the District consented to the District and Spinnaker Waterfront Hotel, LLC, a California limited liability company, (as successor in interest to Fifth Avenue Landing, LLC) amending the lease agreement dated 9 October 1984 in accordance with the Amended, Restated and Combined Lease, on file in the office of the District Clerk as Document No. 53428, for premises located at Convention Way and Marina Park Way in the City of San Diego, California; and
  WHEREAS, pursuant to Ordinance 2498, adopted 6 May 2008, the Board consented to the District and Spinnaker Waterfront Hotel, LLC (Spinnaker) amending the Option Agreement dated 7 October 2003 in accordance with the Agreement for Amendment of Option Agreement, Amendment No. 3, on file in the office of the District Clerk as Document No. 53429, for premises located on the south side of Convention Way, west of Marina Park Way, in the City of San Diego, California; and
  WHEREAS, Spinnaker Waterfront Hotel, LLC failed to close escrow as required by May 20, 2008, and the purchase and sale agreement and corresponding escrow were terminated; and
  WHEREAS, the District desires to rescind said Ordinances 2497 and 2498, NOW, THEREFORE,
 The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1.   That Ordinance 2497, adopted 6 May 2008, amending the lease agreement dated 9 October 1984 between the San Diego Unified Port District and Spinnaker Waterfront Hotel, LLC, a California limited liability company, (as successor in interest to Fifth Avenue Landing, LLC) in accordance with the Amended, Restated and Combined Lease, is hereby rescinded.
  Section 2.   That Ordinance 2498, adopted 6 May 2008, amending the Option Agreement dated 7 October 2003 between the San Diego Unified Port District and Spinnaker Waterfront Hotel, LLC, a California limited liability company, (as successor in interest to Fifth Avenue Landing, LLC) in accordance with the Agreement for Amendment of Option Agreement, Amendment No. 3, is hereby rescinded.
  Section 3.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE GRANTING A LEASE TO STATE OF CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF TRANSPORTATION
 
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. That lease agreement between the San Diego Unified Port District and the State of California, acting by and through its Department of Transportation, on file in the office of the District Clerk, leasing approximately 14,780 square feet of submerged area of San Diego Bay, is hereby approved and granted.
  Section 2. The Executive Director or his authorized representative is hereby directed to execute the said lease agreement with the State of California, acting by and through its Department of Transportation, on behalf of the District.
  Section 3. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE AUTHORIZING AND ACCEPTING A LEASE FROM THE STATE OF CALIFORNIA, ACTING BY AND THROUGH ITS DEPARTMENT OF
TRANSPORTATION
 
  WHEREAS, the San Diego Unified Port District (District) desires to lease from the State of California approximately 14,780 square feet of land area at the National City Jetty, located to the south of Pier 32 Marina, which lease will enhance additional public access to the waterfront, NOW, THEREFORE,
 The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. That lease agreement from the State of California, acting by and through its Department of Transportation, to the San Diego Unified Port District, a public corporation, on file in the office of the District Clerk, leasing to the District approximately 14,780 square feet of land area at the National City Jetty, located to the south of Pier 32 Marina, is hereby authorized, approved and accepted as recommended by the Executive Director.
  Section 2. The Executive Director or his authorized representative is hereby directed to execute the said lease agreement with the State of California, acting by and through its Department of Transportation, on behalf of the District.
  Section 3. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners

AN ORDINANCE AMENDING ORDINANCE 2519 ENTITLED "AN ORDINANCE ESTABLISHING A SCHEDULE OF COMPENSATION FOR OFFICERS AND
EMPLOYEES OF THE SAN DIEGO UNIFIED PORT DISTRICT"
 
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. That Ordinance 2519 entitled "An Ordinance Establishing a Schedule of Compensation for Officers and Employees of the San Diego Unified Port District" is hereby amended by amending Section 17 thereto entitled "Differential for Certain Assignments" to read as follows:
  "Section 17. DIFFERENTIAL FOR CERTAIN ASSIGNMENTS:
  * * *
   "Any full-time employee in Group E - Peace Officer shall be paid a differential of One Dollar ($1.00) per hour when regularly assigned to one of the following administrative assignments:  Investigations, Training Coordinator, Fire Training Coordinator, Joint Terrorism Task Force (JTTF), Marine Task Force (MTF), Narcotics Task Force (NTF), Training Sergeant, Homeland Security Officer and Sergeant, Internal Affairs (IA) Sergeant, Investigations Sergeant and Bay Control Officer."
  Section 2. That said Ordinance 2519 is hereby further amended by amending Exhibit D thereto entitled "Salary Schedule by Range and Step for All Step Peace Officers" in accordance with Exhibit D, attached hereto.
  Section 3. This Ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners; provided, however, all negotiated increases for Police Officers pursuant to this Ordinance shall be effective retroactive to October 1, 2008.

AN ORDINANCE AMENDING  PORT OF SAN DIEGO TARIFF 1-G
 
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1.   Tariff No. 1-G, posted on the website for the San Diego Unified Port District (District) at www.portofsandiego.org (Organization No. 011576 Tariff No. 1-G), and the paper format version on file in the office of the District Clerk as Document No. 31231, are hereby amended by the adoption of the following revision to Section IX, Rules & Rates, Wharfage, Commodity, the modification of Item Nos. 0630, 0631, 0660, 0662, 0663, 0664, 0671, 0720, 0725 and 0739.
  Section 2.   The Executive Director or his authorized representative is hereby authorized and directed to post the following:  The modification of Item No. 0630, establishing rates for Metals, Loose, in Bundles or Packages, and Steel Coils; the modification of Item No. 0631, establishing Project Rates: Applicable to Shipments in Connection with Removal, Construction, Reconstruction of Major Capital Projects or Facilities; the modification of Item No. 0660, establishing rates for Vehicles (Import/Inbound); the modification of Item No. 0662, establishing the rate for Vehicles (Export/Outbound); the modification of Item No. 0663, establishing rates for Commercial Vehicles, Light and Medium Weight; the modification of Item 0664, establishing the rate for Commercial Vehicles, Heavy Weight; the modification of Item 0671, establishing rates for Buildings, Modules, including Mobile, Per Cubic Meter; the modification of Item 0720, establishing Wharf Storage Rates; the modification of Item 0725, establishing Per Container Wharf Storage Rates; and the modification of Item 0739, establishing a Schedule of Mobile Harbor Crane Fees, as particularly described in said Tariff No. 1-G and incorporated herein by this reference.
  Section 3.   This ordinance shall take effect after posting said revisions on the above-referenced website; provided, however, this ordinance shall not take effect prior to 31 days from its passage by the Board of Port Commissioners or November 6, 2008, whichever date is later.
