NOTICE OF JOINT PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF SAN DIEGO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN DIEGO ON THE PROPOSED SALE OF CERTAIN PROPERTY LOCATED GENERALLY ON THE NORTH SIDE OF CEDAR STREET BETWEEN THE RAIL RIGHT OF WAY AND PACIFIC HIGHWAY IN THE CENTRE CITY REDEVELOPMENT PROJECT AREA TO MONARCH SCHOOL PROJECT
NOTICE IS HEREBY GIVEN that the City Council of the City of San Diego (the "City Council") and the Redevelopment Agency of the City of San Diego (the "Agency") will hold a joint public hearing on November 28, 2006 at the hour of 2 PM, or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et seq
.), for the purpose of considering the proposed sale of certain property in the Centre City Redevelopment Project area to Monarch School Project, a California nonprofit public benefit corporation (Participant).
The proposed sale of property to the Participant will be made in accordance with the California Community Redevelopment Law and pursuant to the proposed Disposition Agreement between the Agency and the Participant subject to covenants, conditions and restrictions necessary to carry out the Redevelopment Plan for the Centre City Redevelopment Project.
The property proposed to be sold to the Participant is the existing location of Monarch School. The property is located in the Centre City area of the City of San Diego which is illustrated and designated as the ASite@ on the Map accompanying this Notice. Sale of the Site to the Participant provides for the continued operation and future expansion of the School. If and at such time as the Participant has raised sufficient funds through its capital campaign, the Site would be redeveloped with a larger school consisting of approximately 33,200 SF with approximately 40 parking spaces in a below-grade garage. The ground floor may contain approximately 1,500 SF of leased space which contributes to the school's programming objectives.
The joint public hearing will be held to consider:
1. The proposed sale of such real property in the Centre City Redevelopment Project area by the Agency to the Participant for the continued operation and planned future expansion of Monarch School.
2. The proposed Disposition Agreement submitted to the Agency in the form
desired by the Participant, which provides for the proposed sale of such real property.
The following documents are available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the offices of the City Clerk, 202 "C" Street, City Administration Building, 2nd Floor, San Diego, California 92101 and at the offices of the Centre City Development Corporation, 225 Broadway, Suite 1100, San Diego, California 92101:
1. A copy of the proposed Disposition Agreement.
2. A summary report which describes and specifies:
a. The costs to be incurred by the Agency under the proposed Agreement;
b. The estimated value of the interest to be sold pursuant to the proposed Agreement determined at the highest and best use permitted under the Centre City Redevelopment Plan;
c. The estimated value of the interest to be conveyed at the use and with the conditions, covenants and development costs required by the sale;
d. The purchase price to be paid for the property under the Agreement;
e. An explanation of the difference, if any, between the sale price and the fair market value at the highest and best use consistent with the Centre City Redevelopment Plan; and
f. An explanation of why the sale of the property will assist with the
elimination of blight.
As the Agency responsible for carrying out the Redevelopment Plan for the Centre City Redevelopment Project, the Agency has previously prepared, and the Agency (Resolution No. R-04001) and City Council (Resolution No. R-301265) have certified, the Environmental Impact Report for the San Diego Downtown Community Plan, Centre City Planned District Ordinance and Tenth Amendment to the Redevelopment Plan for the Centre City Redevelopment Project (the AEIR@). The sale of the property and the planned future expansion of Monarch School pursuant to the provisions of the proposed Agreement is a redevelopment implementation activity whose environmental impacts are assessed in the EIR, and encompassed within the certifications, findings, and approvals of the above referenced resolutions of the Agency and City Council. In connection with its consideration of the proposed Agreement, the Agency has prepared a Secondary Study to determine if the development thereunder will have additional significant effects on the environment to those covered in the EIR. As a result of the Secondary Study, no negative declaration and no subsequent environmental impact report or supplement or addendum to the EIR has been prepared with respect to the proposed Agreement. Copies of the Secondary Study and the EIR are available for public inspection and copying in the offices of the City Clerk and Centre City Development Corporation in the places and times specified herein above.
At any time before the date and time set forth above for the joint public hearing by the City Council and Agency, any written comments on or objections to the proposed Agreement or to the proposed sale of the property may be filed with the City Clerk. Comments may also be submitted during such period on the summary report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the joint public hearing will be given an opportunity to appear and be so heard. If you challenge the approval of the proposed Agreement, or any of the matters related thereto as referred to in this Notice, you may be limited to raising only those issues addressed at the hearing described in this Notice or in written correspondence delivered to the City Clerk at, or prior to, the hearing.
