Notice is hereby given that, subject to confirmation by this Court unless otherwise excused, on Nov. 25, 2008, at 12:00 p.m., or thereafter within the time allowed by law, Elizabeth S. Del Pozo, as Conservator of the Person and Estate of JOSEPH K. RYU, and as the Trustee of the JOSEPH K. RYU TRUST dated May 4, 2000, will sell at private sale to the highest and best net bidder on the terms and conditions hereinafter mentioned, all right, title, and interest of the Conservatee and all right, title, and interest that the Trust owns in the real property located in San Diego County, California, described as follows:
Lot 28 of Cabrillo Mesa, in the City of San Diego, County of San Diego, State of California, according to Map thereof No. 3385, filed in the Office of the County Recorder of San Diego County, February 29, 1956.
This property is commonly known as 3131 Chauncy Drive, San Diego, CA 92123.
The sale is subject to current taxes, covenants, conditions, restrictions, reservations, rights, rights of way, and easements of record, with any encumbrances of record to be satisfied from the purchase price. The property is to be sold on an as is basis, except for title.
Bids or offers are incited for this property and must be in writing and will be received at the office of Kimball, Tirey & St. John, attorney for the Personal Representative, at 1202 Kettner Blvd., Third Floor, San Diego, CA 92101 or delivered to CHARLES SCOTT of Kimball, Tirey & St. John personally, at any time after first publication of this notice and before any sale is made.
The property will be sold on the following terms: Cash for full purchase price or acceptable credit sale under the terms of Probate Code §10315, 10 percent of the amount of the bid to accompany the offer by certified check, sale to be subject to confirmation by the court, if required, and if so pursuant to the terms of Probate Code § 103119d) as to any credit terms. Taxes, rents, operating and maintenance expenses, and premiums on insurance shall be prorated as of the date of confirmation of sale. Examination of title, recording of conveyance, transfer taxes, and any title insurance policy shall be at the expense of the purchaser or purchasers
