NOTICE OF JOINT PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF SAN DIEGO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN DIEGO ON THE PROPOSED SALE OF CERTAIN PROPERTY LOCATED AT 4332 UNIVERSITY AVENUE IN THE CITY HEIGHTS REDEVELOPMENT PROJECT AREA TO CITY HEIGHTS REALTY, LLC.
On December 2, 2008, the City Council of the City of San Diego (the “City Council”) and the Redevelopment Agency of the City of San Diego (the “Agency”) will hold a joint public hearing at the hour of 2:00 p.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et seq.), for the purpose of considering the proposed sale of certain property in the City Heights Redevelopment Project Area to City Heights Realty, LLC, a California limited liability company (the "Developer") pursuant to the Disposition and Development Agreement dated May 10, 2005, as amended by the First Implementation Agreement dated November 30, 2007, and further amended by the proposed Second Implementation Agreement which is the subject of the joint public hearing referred to in this Notice (collectively referred to herein as the “Agreement”) .
The proposed sale of property to the Developer will be made in accordance with the California Community Redevelopment Law and pursuant to the Agreement including the proposed Second Implementation Agreement to the Disposition and Development Agreement for the City Heights Square Project between the Agency and the Developer subject to covenants, conditions and restrictions necessary to carry out the Redevelopment Plan for the City Heights Redevelopment Project.
The property proposed to be sold to the Developer consists of that property located at 4332 University Avenue in the City Heights Redevelopment Project Area of the City of San Diego which is illustrated and designated as the Acquisition Parcel on the Site Map accompanying this Notice. The Acquisition Parcel would be combined with the adjacent Developer's Parcel under the proposed Agreement to create the Site upon which the development would be constructed. The Developer's Parcel and the Site are also shown on the Site Map. The Site would be developed with a five-story building, with 92 residential apartment units, approximately 23,500 leasable square feet of retail/office space with covered surface parking and two levels of underground parking.
The joint public hearing will be held to consider:
1. The proposed sale of such real property in the City Heights Redevelopment Project area by the Agency to the Developer for the construction by the Developer residential/commercial mixed-use development.
2. The Second Implementation Agreement to the Disposition and Development Agreement for the City Heights Square Project submitted to the Agency in the form desired by the Developer, which amends the existing Disposition and Development Agreement and the First Implementation Agreement thereto and which provides for the proposed sale of such real property.
The City of San Diego previously prepared an Addendum to Mitigated Negative Declaration (MND) No. 40960 (Project No. 95232) and Mitigated Negative Declaration (MND) No. 40960. Based upon the proposed Second Implementation Agreement, a Subsequent Addendum to the Mitigated Negative Declaration (Project No. 146605) has been prepared. All mitigation measures included in the previous Mitigated Negative Declaration No. 40960 and in the No. 95232 Addendum have been incorporated into the Subsequent Addendum.
The following documents are available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the offices of the City Clerk, 202 "C" Street, City Administration Building, 2nd Floor, San Diego, California 92101, the Redevelopment Agency offices, at the Civic Center Plaza Building, 1200 Third Avenue (14th Floor) San Diego, California 92101 or the Internet at http://www.sandiego.gov/redevelopment-agency/index.shtml:
1. A copy of the proposed Second Implementation Agreement to Disposition and Development Agreement.
2. A copy of the First Implementation Agreement to the Disposition and Development Agreement (City Heights Square Office and Retail Project), which includes as an attachment a copy of the original Disposition and Development Agreement.
3. A Summary Report which describes and specifies:
a. The costs incurred by the Agency as proposed to be amended by the Second Implementation Agreement;
b. The estimated value of the interest to be sold pursuant to the proposed Second Implementation Agreement determined at the highest and best use permitted under the City Heights Redevelopment Plan;
c. The estimated value of the interest to be conveyed at the use and with the conditions, covenants and development costs required by the sale;
d. The purchase price to be paid for the property under the proposed Second Implementation Agreement;
e. An explanation of the difference, if any, between the sale price and the fair market value at the highest and best use consistent with the City Heights Redevelopment Plan; and
f. An explanation of why the sale of the property will assist with the elimination of blight.
4. A copy of the Subsequent Addendum to Mitigated Negative Declaration (Project No. 146605).
At any time before the date and time set forth above for the joint public hearing by the City Council and Agency, any written comments on or objections to the proposed Second Implementation Agreement or to the proposed sale of the property may be filed with the City Clerk. Comments may also be submitted during such period on the Summary Report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the joint public hearing will be given an opportunity to appear and be so heard. If you challenge the approval of the proposed Second Implementation Agreement, or any of the matters related thereto as referred to in this Notice, you may be limited to raising only those issues addressed at the hearing described in this Notice or in written correspondence delivered to the City Clerk at, or prior to, the hearing.

PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:
Matter of the appeal by Geroge Krikorian, from the decision of the Planning Commission approving an application for an addition and remodel of an existing single-family residence on a 22,725 square foot site. The request includes the improvements and additions that were constructed without obtaining an amendment to the original Coastal Commission Permit and/or obtaining building and public improvement permits pursuant to Neighborhood Code Compliance Department (NCCD) Case No. NC40952. The proposed project will conform to Council Policy 900-14 criteria by generating 50% or more of the projected total energy consumption on site through renewable energy resources (i.e. photovoltaics). The property is located at 7957 Princess Street in the RS-1-7 and SF Zone of the La Jolla Shores Planned District within the La Jolla Community Plan Area, Coastal Overlay Zone (Appealable Area), Coastal Height Limitation Overlay Zone, Sensitive Coastal Overlay Zone, the Beach Impact Area of the Parking Impact Overlay Zone, Residential Tandem Parking Overlay Zone, Transit Area Overlay Zone, and Council District 1.
A Coastal Development Permit will be processed and issued by the California Coastal Commission (as an amendment to the original coastal development permit issued by the Commission) once all of the City's actions have been completed.
The final decision by the City of San Diego is appealable to the California Coastal Commission. Appeals to the Coastal Commission must be filed with the Coastal Commission at 7575 Metropolitan Drive, Suite 103, San Diego, CA 92108. Phone: (619) 767-2370. Appeals must be filed within 10 working days of the Coastal Commission receiving a notice of final action from the City. NOTICE IS HEREBY GIVEN that a public hearing will be held on Tuesday, November 18, 2008 in the City of San Diego Council Chambers located at 202 C Street, 12th Floor, San Diego, CA 92101. The purpose of the hearing is to provide San Diego citizens with the opportunity to voice their opinions on and participate in one substantial amendment of the City's Annual Action Plan for fiscal year.
The Mayor and City Council will consider adopting the Neighborhood Stabilization Program (NSP) as a substantial amendment to the FY 2009 Annual Action Plan. The U.S. Department of Housing and Urban Development (HUD) developed the program under Title III of Division B of the Housing and Economic Recovery Act of 2008. These funds have been allocated to states and cities nationwide that have been affected by a high rate of foreclosures. The funds must be used in targeted areas of “greatest need” within the City of San Diego for the purpose of acquiring, rehabilitating and the re-sale of “foreclosed/abandoned” residential properties. As a grantee, the City is required to submit a plan to HUD for the use of NSP funds as a substantial amendment to the City's FY 2009 Annual Action Plan no later than December 1, 2008. The City's total NSP entitlement upon approval of the Plan is approximately $9.4M. Public input is welcome. Citizens may participate in written form prior to the public hearings or orally during the hearing. A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN DIEGO DECLARING ITS INTENTION TO DESIGNATE AN AREA OF BENEFIT IN UNIVERSITY CITY AND SETTING THE TIME AND PLACE FOR HOLDING A PUBLIC HEARING THEREON.

WHEREAS, the Council of the City of San Diego [Council] desires to initiate proceedings for the designation of a facilities benefit assessment area of benefit in North University City pursuant to Ordinance No. 15318 (New Series) of the Council [Ordinance] which area of benefit will specially benefit from the acquisition, improvement and construction of certain public improvements more particularly described in the document titled, “North University City Public Facilities Financing Plan and Facilities Benefit Assessment, Fiscal Year 2009,” [Report]; and
WHEREAS, the Mayor, with the assistance of the City Planning & Community Investment Department, made and filed with the City Clerk, the Report, a copy of which is on file in the office of the City Clerk as Document No. RR-304343; and
WHEREAS, the Council has examined and considered the Report, including the community financing plan and capital improvement program with respect to the proposed public facilities projects; the proposed boundaries of the facilities benefit assessment area of benefit; the general description of the public facilities projects; the estimated costs for the construction of said public facilities projects; the method pursuant to which the costs are to be apportioned among the parcels within the area of benefit and the amount of the facilities benefit assessments which will be charged to each such parcel; the basis and methodology by which automatic annual increases in the facilities benefit assessment will be computed, assessed and levied pursuant to Section 61.2212 of the Ordinance; and the amount of the contribution or advance which the City or other public entity will make toward the total cost of the public facilities projects; NOW, THEREFORE,
BE IT RESOLVED, by the Council of the City of San Diego, as follows:
1. The Council declares its intention to designate an area of benefit within North University City to finance the cost of the public facilities projects pursuant to the Ordinance.
2. The Council is satisfied with the correctness of the Report, including, without limitation, the community finance plan and capital improvement program with respect to said public facilities projects; the proposed boundaries of the facilities benefit assessment area of benefit; the description of the public facilities projects; the estimated costs for the construction of the public facilities projects; the method pursuant to which the costs are to be apportioned among the parcels within the facilities benefit assessment area of benefit, and the amount of the facilities benefit assessments which will be charged to each such parcel; the basis and methodology by which automatic increases in the facilities benefit assessments will be computed, assessed and levied pursuant to Section 61.2212 of the Ordinance; and the amount of the contribution or advance which the City or other public entity will make toward the total cost of the public facilities projects. The Council does confirm and approve the Report.
3. The public facilities projects will be undertaken and completed as described in the Report.
4. The community financing plan and capital improvement program with respect to the public facilities projects will be as set forth in the Report.
5. The boundaries of the facilities benefit assessment area of benefit will be as set forth in the Report.
6. The method pursuant to which the cost of the public facilities project is to be apportioned among the parcels within the facilities benefit assessment area of benefit and the amount of the facilities benefit assessments which will be charged to each such parcel will be as set forth in the Report.
7. The Council determines it necessary to provide for automatic increases in the amount of facilities benefit assessments for landowners who have not paid their facilities benefit assessments without the necessity for further proceeding pursuant to Section 61.2212 of the Ordinance in order to reflect increases in the cost of money during the period between the imposition of the facilities benefit assessment, the payment of facilities benefit assessments and completion of the public facilities projects. The Council further determines that the basis and methodology for computing such increases set forth in the Report is reasonable and appropriate in order to provide an equitable distribution of the cost of the public facilities projects to community developers and the ultimate purchasers of developed properties.
8. All fees due under the North University City Public Facilities Financing Plan and Facilities Benefit Assessment, Fiscal Year 2009, shall be those fees in effect at the time the building permit is issued.
9. The amount of contribution or advance which the City or other public entity will make toward the total cost of the public facilities project will be as set forth in the Report.
10. The Council shall hold a public hearing to consider the designation of the area of benefit as proposed in this resolution at 10:00 a.m. on the 5th day of December, 2008, at the Council Chambers, 202 C Street, San Diego, California.
11. The City Clerk is authorized and directed to give notice of the public hearing described in paragraph 10 of this resolution by publishing this Resolution in the “San Diego Daily Transcript” at least two weeks before the date set forth herein and by mailing copies of this resolution to each owner of property located within the proposed area of benefit at the addresses shown on the last equalized property tax assessment roll, or as otherwise known to the City Clerk pursuant to Section 61.2205 of the Ordinance.
BE IT FURTHER RESOLVED, that this activity is not subject to CEQA pursuant to State CEQA Guidelines Sections 15060(c)(3) & 15378(b)(4).
