PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of the City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:

The Draft 2005-2010 General Plan and Progress Guide Housing Element

The Housing Element contains strategies, policies and programs for addressing the following goals: Ensuring provision of sufficient housing for all income groups, preserving affordable housing stock, minimizing governmental constraints to providing housing, providing affordable housing opportunities for low- and moderate-income residents, and complying with all applicable laws and regulations relating to housing.
All California cities are required to prepare a Housing Element and to update that document approximately every five years. Jurisdictions in San Diego County are required to prepare a Housing Element covering the period from July 1, 2005-June 30, 2010. In accordance with state law, the draft Housing Element contains an inventory of sites currently zoned and potentially available to accommodate residential development.
The City Council will make a determination regarding whether to adopt the draft Housing Element and whether to certify the Addendum to EIR No. 40-1027 (Environmental Project No. 90947).

COMMUNICATIONS
This item may begin at any time after the time specified. Any interested person may address the City Council to express support or opposition to this issue. Time allotted to each speaker is determined by the Chair and, in general, is limited to three (3) minutes; moreover, collective testimony by those in support or opposition shall be limited to no more than fifteen (15) minutes total per side.

As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Map Waiver (Process 3) to waive the requirement for a Tentative Map to convert six (6) existing residential units to condominiums that are currently under construction (Building Permit No. 237967 and 237974 through 237978 issued on January 30, 2006) and to waive the requirement for undergrounding overhead utilities within the public right-of-way. The proposed project will conform to the Council Policy 900-14 criteria by generating 50% or more of the projected total energy consumption on site through renewable energy resources (i.e. photovoltaic). The 0.16-acre site is located at 4079 through 4089 Normal Street in the MR-800B Zone of the Mid-City Communities Planned District within the Uptown Community Planning Area, and Council District 3.
The decision of the Hearing Officer is final unless appealed to the Planning Commission. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained at the Development Services Department, Project Management Section, Reception Desk; located at 1222 First Avenue, 3rd Floor, San Diego, CA. The appeal must be made within 10 working days of the Hearing Officer's decision.
This project was determined to be categorically exempt from the California Environmental Quality Act on September 1, 2006, and the opportunity to appeal that determination ended September 15, 2006.
The decision made by the Planning Commission is the final decision by the City.
If you wish to challenge the City's action on the above proceedings in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written in correspondence to the City at or before the public hearing. If you have any questions after reviewing this notice, you can call the City Project Manager listed above.
This information will be made available in alternative formats upon request. To request an agenda in alternative format or to request a sign language or oral interpreter for the meeting, call the Disability Services Program Coordinator at 236-5679, at least five working days prior to the meeting to insure availability.
