As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Conditional Use Permit to upgrade an existing Type 20 (beer and wine only) ABC license to a Type 21 (permitting the general sales of alcohol products) at an existing market located at 4727 Federal Blvd in the CC-5-3 Zone of Central Urbanized Planned District within the Eastern Area Neighborhood of Mid City Communities Plan Area.
The decision of the Hearing Officer is final unless appealed to the Planning Commission. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal must be made within 10 working days of the Hearing Officer's decision. Please do not e-mail appeals as they will not be accepted. The decision made by the Planning Commission is the final decision by the City.

PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:

Public Rights-of-Way Vacations and Water, Sewer and Pedestrian Access easement reservations located along Montezuma Place between Aztec Walk and Montezuma Road for future expansion of San Diego State University for the addition of student housing, commercial/retail establishments, and support uses to include retail parking, and a green space promenade. The project is within the College Area Community Plan and zoned CN-1-2.

On November 1, 2012 the Planning Commission voted 6-0-0 to recommend approval to the City Council to approve the proposed project.

Environmental Impact Report (EIR) SCH No. 2009011040 was prepared for the Plaza Linda Verde Project. It was certified by the California State University Board of Trustees as Lead Agency on May 10, 2011. Currently, Public Right-of-Way Vacations and Water & Sewer/Pedestrian Access easement reservations located along Montezuma Place between Aztec Walk and Montezuma Road are being requested. The City of San Diego is the Responsible Agency for this action.

The project was reviewed and it was determined that in accordance with California Environmental Quality Act (CEQA) Guidelines Section 15162(a):

(1) No substantial changes are proposed to the project which would
require major revisions of the previous EIR;
(2) No substantial changes occur with respect to the circumstances under
which the project is undertaken that would require any revisions to the
previous EIR; and
(3) there is no new information of substantial importance that was not
known and could not have been known at the time the previous EIR was certified.

Therefore, no subsequent environmental document is required, in that no new additional impacts and/or mitigation measures are required beyond those that were analyzed in the original environmental document. All of the impacts were adequately addressed and disclosed in previously certified (EIR) SCH No. 2009011040.

The decision of the City Council is final.

This item may begin at any time after the time specified. Any interested person may address the City Council to express support or opposition to this issue. Time allotted to each speaker is determined by the Chair and, in general, is limited to three (3) minutes; moreover, collective testimony by those in support or opposition shall be limited to no more than fifteen (15) minutes total per side.
