 AN ORDINANCE GRANTING AN EASEMENT FOR UTILITY PURPOSES TO SAN DIEGO GAS & ELECTRIC COMPANY
 
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. The Easement for Utility Purposes between the San Diego Unified Port District, a public corporation, and San Diego Gas & Electric Company, a California corporation, for utility purposes in, on, over, under, across and through the approximately 2,880 square feet of tidelands area located on Bay Marina Drive, west of Quay Avenue, in the City of National City, on file in the office of the District Clerk, is hereby approved and granted.
Section 2. The Executive Director or his authorized representative is hereby directed to execute the said Easement with San Diego Gas & Electric Company.
Section 3. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. That the Option to Lease Agreement dated 11 January 2005 between the San Diego Unified Port District and Seaport Village Operating Co., LLC, a Delaware limited liability company, is hereby amended in accordance with Agreement For Amendment of Option Agreement Between San Diego Unified Port District and Seaport Village Operating Co., LLC, Amendment No. 10, on file in the office of the District Clerk.
Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

 AN ORDINANCE AMENDING OPTION TO LEASE AGREEMENT BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND LANE FIELD SAN DIEGO
DEVELOPERS, LLC
The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1. That Option to Lease Agreement dated 5 December 2006 between the San Diego Unified Port District and Lane Field San Diego Developers, LLC, a Delaware limited liability company, (Lane Field South Hotel Site) is hereby amended in accordance with Agreement for Amendment of Option to Lease Agreement, Amendment No. 2, including without limitation extending the term of said option to 5:00 P.M. on October 30, 2009; amending Paragraph 4, Option Agreement Consideration, to extend the last date for installment payments to October 30, 2009; amending Paragraph 5, Conditions Precedent, by replacing the dates for completion for Subparagraphs 5.o., 5.q., 5.r., 5.s., 5.t., 5u., 5.v. and 5.w.; amending Paragraph 15, Force Majeure, Subparagraph (1) Non-Litigation Force-Majeure, to extend the period of excused delays for Non-Litigation Force Majeure Events to Five Hundred Forty Five (545) days in the aggregate, and further amending Paragraph 15, Subparagraph (2), Litigation Force Majeure, to extend the period of excused delays for Litigation Force Majeure Events to Five Hundred Forty Five (545) days in the aggregate, in accordance with the terms, covenants and conditions contained in said Agreement for Amendment of Option to Lease Agreement, Amendment No. 2, on file in the office of the District Clerk.
Section 2. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

Section 1. That Option to Lease Agreement dated 13 February 2007 between the San Diego Unified Port District and Lane Field San Diego Developers, LLC, a Delaware limited liability company, (Lane Field North Hotel Site) is hereby amended in accordance with Agreement for Amendment of Option to Lease Agreement, Amendment No. 1, including without limitation extending the term of said option to 5:00 P.M. on February 26, 2010, extending the term to negotiate an option and lease agreement with the United States Navy for property located at 1220 Pacific Highway to November 30, 2009, amending Paragraph 5, Conditions Precedent, by replacing the dates for completion for Subparagraphs 5.j., 5.k., 5.l., 5.m., 5.n., 5.o., 5.p., 5.q., 5.r. and 5.s, and amending Paragraph 15, Force Majeure, Subparagraph a., Non-Litigation Force Majeure, to extend the period of excused delays for Non-Litigation Force Majeure Events  to Three Hundred Sixty Five (365) days in the aggregate, in accordance with the terms, covenants and conditions contained in said Agreement for Amendment of Option to Lease Agreement, Amendment No. 1, on file in the office of the District Clerk.
Section 2. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.
