NOTICE OF JOINT PUBLIC HEARING BY THE CITY COUNCIL OF THE CITY OF SAN DIEGO AND THE REDEVELOPMENT AGENCY OF THE CITY OF SAN DIEGO ON THE PROPOSED SALE OF CERTAIN PROPERTY LOCATED AT 4332 UNIVERSITY AVENUE IN THE CITY HEIGHTS REDEVELOPMENT PROJECT AREA TO CITY HEIGHTS REALTY, LLC.
On December 2, 2008, the City Council of the City of San Diego (the City Council) and the Redevelopment Agency of the City of San Diego (the Agency) will hold a joint public hearing at the hour of 2:00 p.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to the California Community Redevelopment Law (Health and Safety Code, Sections 33000, et seq.), for the purpose of considering the proposed sale of certain property in the City Heights Redevelopment Project Area to City Heights Realty, LLC, a California limited liability company (the "Developer") pursuant to the Disposition and Development Agreement dated May 10, 2005, as amended by the First Implementation Agreement dated November 30, 2007, and further amended by the proposed Second Implementation Agreement which is the subject of the joint public hearing referred to in this Notice (collectively referred to herein as the Agreement) .
The proposed sale of property to the Developer will be made in accordance with the California Community Redevelopment Law and pursuant to the Agreement including the proposed Second Implementation Agreement to the Disposition and Development Agreement for the City Heights Square Project between the Agency and the Developer subject to covenants, conditions and restrictions necessary to carry out the Redevelopment Plan for the City Heights Redevelopment Project.
The property proposed to be sold to the Developer consists of that property located at 4332 University Avenue in the City Heights Redevelopment Project Area of the City of San Diego which is illustrated and designated as the Acquisition Parcel on the Site Map accompanying this Notice. The Acquisition Parcel would be combined with the adjacent Developer's Parcel under the proposed Agreement to create the Site upon which the development would be constructed. The Developer's Parcel and the Site are also shown on the Site Map. The Site would be developed with a five-story building, with 92 residential apartment units, approximately 23,500 leasable square feet of retail/office space with covered surface parking and two levels of underground parking.
The joint public hearing will be held to consider:
1. The proposed sale of such real property in the City Heights Redevelopment Project area by the Agency to the Developer for the construction by the Developer residential/commercial mixed-use development.
2. The Second Implementation Agreement to the Disposition and Development Agreement for the City Heights Square Project submitted to the Agency in the form desired by the Developer, which amends the existing Disposition and Development Agreement and the First Implementation Agreement thereto and which provides for the proposed sale of such real property.
The City of San Diego previously prepared an Addendum to Mitigated Negative Declaration (MND) No. 40960 (Project No. 95232) and Mitigated Negative Declaration (MND) No. 40960. Based upon the proposed Second Implementation Agreement, a Subsequent Addendum to the Mitigated Negative Declaration (Project No. 146605) has been prepared. All mitigation measures included in the previous Mitigated Negative Declaration No. 40960 and in the No. 95232 Addendum have been incorporated into the Subsequent Addendum.

1. A copy of the proposed Second Implementation Agreement to Disposition and Development Agreement.
2. A copy of the First Implementation Agreement to the Disposition and Development Agreement (City Heights Square Office and Retail Project), which includes as an attachment a copy of the original Disposition and Development Agreement.
3. A Summary Report which describes and specifies:
a. The costs incurred by the Agency as proposed to be amended by the Second Implementation Agreement;
b. The estimated value of the interest to be sold pursuant to the proposed Second Implementation Agreement determined at the highest and best use permitted under the City Heights Redevelopment Plan;
c. The estimated value of the interest to be conveyed at the use and with the conditions, covenants and development costs required by the sale;
d. The purchase price to be paid for the property under the proposed Second Implementation Agreement;
e. An explanation of the difference, if any, between the sale price and the fair market value at the highest and best use consistent with the City Heights Redevelopment Plan; and
f. An explanation of why the sale of the property will assist with the elimination of blight.
4. A copy of the Subsequent Addendum to Mitigated Negative Declaration (Project No. 146605).
At any time before the date and time set forth above for the joint public hearing by the City Council and Agency, any written comments on or objections to the proposed Second Implementation Agreement or to the proposed sale of the property may be filed with the City Clerk. Comments may also be submitted during such period on the Summary Report and other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the joint public hearing will be given an opportunity to appear and be so heard. If you challenge the approval of the proposed Second Implementation Agreement, or any of the matters related thereto as referred to in this Notice, you may be limited to raising only those issues addressed at the hearing described in this Notice or in written correspondence delivered to the City Clerk at, or prior to, the hearing.

Notice of Intent to Modify Floodplain/Floodway
The City of San Diego Engineering & Capital Projects Department, in accordance with the National Flood Insurance Program regulation 65.7(b)(1), hereby gives notice of the City's intent to revise the floodplain and establish a floodway along Gonzales Canyon Creek, generally located between Old El Camino Real and a location approximately 1,850 feet east of Old El Camino Real. Specifically, the floodplain shall be revised from a point approximately 210 feet downstream of Old El Camino Real to a point approximately 2,140 feet upstream of Old El Camino Real. The floodway shall be established from Old El Camino Real to a point approximately 2,140 feet upstream of Old El Camino Real with a maximum width of approximately 100 feet at a point approximately 60 feet upstream of Old El Camino Real.
