The following Applicant, Damon C. Thomas, furnishes information to the Court:
1. Douglas Daniel Winters (”Decedent”) died on October 19, 2007, at the age of 51 years, in La Jolla, San Diego County, California. Decedent was living temporarily at 9888 Genesee Ave., La Jolla, California 92037.
2. No Administration is pending upon Decedent’s Estate and none is necessary. Decedent did not own any real or personal property. Therefore, it is in the best interest of this Estate for the Court to determine who are the lawful and only heirs of the Decedent.
3. Decedent claims to be a part owner of the Estate of Carol Ann Winters, Deceased, that is pending in this Honorable Court.
The social security number of Decedent is unknown; and the driver’s license of Decedent is also unknown.
4. The names and residences of all the Decedent’s heirs, the relationship of each Heir to Decedent; and the true interest of the Applicant and each of the Heirs in the Estate of Decedent are as follows:
(1) John R. Winters; 11 East Gate Lane; Enfield, Ct. 06082; 1/5th of personal property of the Estate of Douglas Daniel Winters, Deceased; Adult Brother.
(2) Richard J. Winters, Jr., 2801 Traveller St., League City, Texas 77573; 1/5th of the personal property of the Estate of Douglas Daniel Winters, Deceased; Adult Brother.
(3) Stephen F. Winters, 2018 Westlake Way, Houston, Texas 77084; 1/5th of the personal property of the Estate of Douglas Daniel Winters; Adult Brother.
(4) Janice Morton; 987 Conestoga, Livingston, Texas 77351; 1/5th of the personal property of the Estate of Douglas Daniel Winters, Deceased; Adult Sister.
(5) Karen W. Touring; 2013 N. Fry Rd., Katy, Texas 77449; 1/5th of personal property of the Estate of Douglas Daniel Winters, Deceased; Adult Sister.
5. At the time of Decedent’s death, Decedent did not own any real property in the State of any other State. Decedent did own a 1/6th interest in the Estate of Carol Ann Winters, Deceased, in Cause No. P-07-44.
6. The listing of the Heirs of Decedent is are forth in no. 4 herein.
7. Decedent had never been married.
8. Decedent never a child nor did he ever adopt a child.
9. To the best of my knowledge, Decedent died intestate.
10. This Application does not omit any information required by the Texas Probate Code, Section 49, except as follows: None.
11. There are no debts owed by Decedent; and there is no need necessity for an administration of this Estate.
12. This Application contains all of the material facts and circumstances within the knowledge and information of the Applicant that might reasonable tend to show the time of place of death or the names or residences of all Heirs, if the time or place of death or the names or residences of all the Heirs are not definitely known to the Applicant, except as follows: NONE
Applicant prays that citation issue as required by law; that an Attorney ad Litem be appointed to represent the interests of unknown heirs; that upon hearing hereof, this Court determine who are the heirs and only heirs of Decedent and their respective shares and interests in this Estate; and that no necessity for an administration of Decedent’s Estate.
