NOTICE IS HEREBY GIVEN that the Redevelopment Agency of the City of San Diego (the “Agency”) and the City Council of the City of San Diego (the “Council”) has scheduled a joint public hearing for March 4, 2008, at the hour of 2 p.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor of the City Administration Building, 202 C Street, San Diego, California, pursuant to Sections 33431 and 33433 of the California Health and Safety Code, for the purpose of considering a proposed Disposition and Development Agreement (DDA) by and between the Redevelopment Agency of the City of San Diego and SYEP Associates, a California limited partnership (the “Developer”), for the El Pedregal Family Apartments Project. The DDA proposes the possible acquisition and disposition of real property by the Agency located within the San Ysidro Redevelopment Project Area. The DDA sets forth the conditions and procedures under which the Agency may acquire real property and sell said property to the Developer to develop the Project.
The proposed Project involves a 2.24-acre vacant site located at 104 Averil Road, within the San Ysidro Redevelopment Project Area. The proposed Project includes the development of a new 45-unit rental housing project with rents restricted for 55 years to households earning between 30% to 60% of the Area Median Income. The Project's design consists of two 2- and 3- story buildings with subterranean parking. The Gross Building Area is approximately 70,110-sf, with a total of 105 parking spaces. Amenities shall include recreation/play facilities, a computer room, a multipurpose center, education programs, and a picnic area. A Mitigated Negative Declaration was certified by the City for the Project on June 13, 2007. The Project site is fully entitled.
Other actions to be considered by the City Council and the Agency include terminating the previously approved Owner Participation Agreement (OPA) dated July 10, 2007 by and between the Agency and the Developer for said Project, approving the Basic Concept Drawings, approving Findings of Benefit for the use of Naval Training Center's 20% housing set-aside funds outside the Naval Training Center Redevelopment Project Area and authorizing the expenditure of funds for the El Pedregal Family Apartments Project in an amount not to exceed $3,606,000 from the Agency's 20% Low and Moderate Income Housing Set-Aside Funds for land acquisition and as an Agency residual receipts loan contribution to the Project, and authorizing the Executive Director of designee to make contingent offers for acquisition of properties for the El Pedregal Family Apartments Project.

At any time before the date and time set forth above for the public hearing of the Redevelopment Agency and City Council, written comments on or objections to the proposed DDA may be filed with the City Clerk. Comments may also be submitted during such period on the other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the public hearing will be given an opportunity to appear and be so heard. The decision of the City Council and Redevelopment Agency is final. If you later desire to challenge actions of the Agency and/or the City Council in connection with these transactions, you could be limited to raising issues that you or someone else raised at the public hearing, or in written correspondence to the Agency and/or the City Council at or prior to the public hearing.

 As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Map Waiver to waive the requirements of a tentative map to create three residential condominium units, (under construction), including a request to waive the requirement to underground existing overhead utilities.  The 0.14-acre site is located at 4581-4585 Bancroft Street in the RM-1-2 Zone of the Central Urbanized Planned District and the Transit Overlay Zone in the Adams Park neighborhood in the Mid-City Community Plan area. 
 The decision of the Hearing Officer is final unless appealed to the Planning Commission.  In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal must be made within 10 working days of the Hearing Officer's decision. AN ORDINANCE AMENDING ORDINANCE NO. O-19652 ENTILTED “AN ORDINANCE ADOPTING THE ANNUAL BUDGET FOR THE FISCAL YEAR 2007-2008 AND APPROPRIATING THE NECESSARY MONEY TO OPERATE THE CITY OF SAN DIEGO FOR SAID FISCAL YEAR,” BY INCREASING REVENUE AND EXPENDITURE APPROPRIATIONS BY $3,000,000 IN THE ESD OPERATING BUDGET 513, FUND 100; AUTHORIZING THE AUDITOR AND COMPTROLLER TO APPROPRIATE AND EXPEND SAID SUM FOR THE 2007 WILD FIRE CLEANUP SERVICES CONTRACTS; AND AUTHORIZING REIMBURSEMENT TO FUND 100 FROM STATE FUNDS ADVANCED FOR PURPOSES OF SAID CONTRACTS
This ordinance provides for reimbursement to the City for expenses of cleanup after the October 2007 wildfires. Partial funding was advanced by the State Office of Emergency Services for reimbursement after payment of cleanup expenses by the City.
This ordinance contains a notice that a full reading of the ordinance is dispensed with prior to passage, since a written copy was made available to the City Council and the public prior to the day of its passage.
This ordinance shall take effect and be in force immediately upon its passage after two public hearings pursuant to the authority contained in City Charter sections 71, 275, and 295.
