that Southwestern Community College District of San Diego County, California, acting by and through its Governing Board, hereinafter referred to as the “DISTRICT” will receive up to, but no later than 10:00 AM of the 29th day of February, 2012, sealed Bids, No. 189, for the award of a contract for Southwestern College Central Plant Concrete and Grading Project”. Bids shall be addressed to John R. The Director of Industrial Relations has determined the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the contract, which will be awarded to the successful bidder, copies of which,
are on file and, will be made available to any interested party upon request at Southwestern Community College. It shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under him, to pay not less than the said specified rates to all workers employed by them in the execution of the contract.
Minority, women, and disabled veteran contractors are encouraged to submit bids. This bid is subject to Disabled Veteran Business Enterprise requirements.
This contract is subject to a labor compliance program, as described in subdivision (b) of section 1771.5 of the Labor Code.
Each bidder shall be a licensed contractor pursuant to the California Business and Professions Code Section 7028.15 and Public Contract Code Section 3300, and shall be licensed in the following classification as required by the scope of work required in the above called out bid packages: C8, Concrete, Any bidder not licensed at the time of the bid opening will be rejected as non-responsive.
Contractors shall have been in business under the same name and California contractor's license for a minimum of three (3) continuous years prior to bid opening.

CITY OF NATIONAL CITY
NOTICE INVITING BIDS

The City Council of the City of National City invites sealed bids for performing the 8th STREET UTILITY UNDERGROUNDING & SEWER REPLACEMENT PROJECT, Specification No. 11-04.

The project includes but not limited to excavation, removals and replacement of asphalt concrete, and portland cement pavement, curb and gutter, concrete sidewalk, and landscape areas to construct underground facilities for electrical, telephone, cable, and installation of concrete pedestals, utility boxes, vaults, handholds, re-establishment of landscape areas and public and private improvements, sanitary sewer system replacement, and cleanouts, asphalt overlay and other items not mentioned above, but are required by the construction documents.
All sealed bid proposals must be received by the Office of the City Clerk located in City Hall, 1243 National City Boulevard, National City, California, 91950, prior to the bid closing on Wednesday, February 29, 2012 at 3:00 P.M. according to the date-stamp clock located in the City Clerk's Office. Immediately following the bid closing time, bids will be publicly opened and read aloud in the second floor, large conference room, of City Hall.
The project documents include, but are limited to, the Standard Specifications for Public Works Construction, 2009 Edition, (Greenbook - including the San Diego supplements), the San Diego Regional Standard Drawings, 2009 Edition, 2011 Supplement, and these contract documents. The Contract Documents may be inspected in the office of the City Engineer, located in City Hall at 1243 National City Boulevard, National City, California, 91950, Telephone Number (619) 336-4380, Fax Number (619) 36-4397. Copies may be obtained at that location upon payment of a non-refundable fee of $140 for each set. (Includes contract documents, but does not include the referenced publications).
A non-mandatory pre-bid meeting has been scheduled for 10:00 a.m. on Thursday, February 16, 2012, to review the project. The pre-bid meeting will take place at the second floor, large conference room in City Hall. Representatives of the City will be present to answer any questions bidders have regarding the project.
Each bid shall be accompanied by the security referred to in the Contract Documents, the non-collusion affidavit, the list of proposed subcontractors, and all additional documentation required by the Instructions to Bidders.
The successful bidder will be required to furnish the City with a Performance Bond equal to 100% of the successful bid, and a Payment Bond equal to 100% of the successful bid, prior to execution of the Contract. All bonds are to be secured from a surety company that meets all of the State of California bonding requirements, as defined in Code of Civil Procedure Section 995.120, and is authorized by the State of California, and all documents required by Code of Civil Procedure Section 995.660, to the extent required by law.
In addition, the successful bidder shall be required to secure a Performance Bond from all subcontractors providing goods and services in excess of $100,000.00. All prime contractors bidding on this project shall specify this requirement regarding subcontractor bonds, in their written or published request for subcontractor bids. Such written or published requests shall clearly designate the party that will bear the cost of the bonds. Vendors only supplying materials shall not be required to provide bonds. All subcontractor bonds are to be secured from a surety company that meets all the State of California bonding requirements, as defined in Code of Civil Procedure Section 995.120, and is authorized by the State of California.
Pursuant to the provisions of Public Contract Code Section 22300, the successful bidder may substitute certain securities for funds withheld by City to ensure his performance under the Contract. At the request and expense of the successful bidder, securities equivalent to any amount withheld shall be deposited at the discretion of City, with either a City or a state or a federally chartered bank, as the escrow agent, who shall then pay any funds otherwise subject to retention to the successful bidder. Upon satisfactory completion of the Contract, the securities shall be returned to the successful bidder.

The City has determined the general prevailing rate per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the Contract which will be awarded to the successful bidder, copies of which are on file and will be made available to any interested party upon request at the Office of the City Engineer.
In accordance with the provisions of the California Labor Code, contractors or subcontractors may not perform work on a public works project with a subcontractor who is ineligible to perform work on a public project pursuant to Section 1777.1 or Section 1777.17 of the California Labor Code. Any contract on a public works project entered into between a contractor and a debarred subcontractor is void as a matter of law. A debarred subcontractor may not receive any public money for performing work as a subcontractor on a public works contract. Any public money that is paid or may have been paid to a debarred subcontractor by a contractor on the Project shall be returned to the City. The Contractor shall be responsible for the payment of wages to workers of a debarred subcontractor who has been allowed to work on the Project.
It shall be mandatory upon the bidder to whom the Contract is awarded, and upon any subcontractor under him, to comply with all Labor Code provisions, which include, but are not limited the payment of not less than the said specified rates to all workers employed by them in the execution of the Contract, employment of apprentices, hours of labor and debarment of contractors and subcontractors.
Each bidder shall be a licensed contractor pursuant to the Business and Professions Code and shall be licensed in the appropriate classification(s) of contractor's license(s), for the work bid upon, and shall maintain the license throughout the duration of the Contract.
Bidders must possess a current State of California Class A Contractor's License.
The Engineer's cost estimate is $3,000,000 for this project.
