Notice is hereby given that Mark Alsten and Brad Alsten, Administrators of the Estate of Christopher Ross Alsten, will sell at private sale to the highest and best bidder subject to confirmation by the San Diego Superior Court, on or after, February 10, 2012 at Meridox Real Estate, 2385 Camino Vida Roble, Suite 112, Carlsbad, CA 92011, the following real property of the estate: all right, title and interest of said decedent at the time of death and all right title and interest in the estate additionally acquired in 3705 Haines Street, San Diego, California, 92109, described as:
Lots 21 and 22 in Block 32 of Second Fortuna Park Addition, in the City of San Diego, County of San Diego, State of California, according to Map thereof No. 895, filed in the Office of the County recorder of San Diego County April 30, 1903, also described as Assessor's Parcel No. 423-443-08-00.
The terms and conditions of sale are: 1. At least ten percent (10%) of the amount bid or offer amount must be paid by cashier's check or certified check with the offer and the balance must be paid on close of escrow after confirmation of sale by the Court, by cashier's check or as the Court orders.
2. Purchase price due in cash or cash equivalent in lawful money of the United States or part cash and balance upon such terms and conditions as are agreeable to the Administrators. 3. Close of escrow within 10 days, or other time period agreeable to Administrators, of delivery of Order Confirming Sale to buyer. 4. Property sold “as is”, without condition, representation, warranty or covenant of any kind, express or implied. No termite clearance is given. No personal property is included. 5. Seller to pay commission from proceeds of sale to the listing broker and purchaser's broker in the sum of five percent (5%) divided equally between them but subject to court confirmation or adjustment. 6. Buyer and Seller will split the escrow fees equally and subject to normal prorates.
Bids or offers for this property must be made in writing and directed to the Administrators, in care of Charles Mackey, Meridox Real Estate, 2385 Camino Vida Roble, Suite 112, Carlsbad, CA 92011, or their attorney, Stephen E. Hurst, at the address, 12707 High Bluff Drive, Suite 100, San Diego, CA 92130. Bids will be received at the aforesaid office at any time after the first publication hereof and before date of sale.
The administrators reserve the right to reject any and all bids or offers. Bids or offers need not be considered unless they substantially comply with the terms of this notice.
