PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:
Matter of approving two agreement(s) to allow for the provision of a temporary secondary source of water and fire protection service to the Black Mountain Ranch LLCÕs development project which consists of residential, commercial, schools, parks, and landscape uses, for up to 4,500 equivalent dwelling units. The Developer is constructing a 24-inch waterline in Camino del Sur to provide a primary source of water and will be completing a waterline in Carmel Valley Road to complete the loop and provide a permanent secondary source of water. At the present time, there are no water pipelines or other water facilities in place to provide a feasible secondary source of water and fire protection service. However, the Olivenhain Municipal Water District has water in close proximity to the project and is agreeable to provide temporary secondary water service.
The two agreements under consideration are as follows:
1) Temporary Water and Fire Protection Service Agreement for the Black Mountain Ranch Phase II Development Site Between the City of San Diego and Olivenhain Municipal Water District - Authorizes OMWD to provide a temporary secondary source of water to this project until such time as the Phase II final loop is completed.
2) Temporary Water and Fire Protection Service Agreement for the Black Mountain Ranch Phase II Development Site Between the City of San Diego and Black Mountain Ranch, LLC Ð Outlines the developerÕs duties and obligations to the City to provide for payment to the City and OMWD, as well as the construction of temporary and permanent facilities.

NOTICE IS HEREBY GIVEN that the Redevelopment Agency of the City of San Diego (the "Agency") will hold a public hearing on March 1, 2005 at the hour of 10:00 a.m., or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor of the City Administration Building at 202 "C" Street, San Diego, CA pursuant to the California Community Redevelopment Law (Health and Safety Code Sections 33000, et seq.) for the purpose of considering the approval of a proposed Cash Depository Agreement ("the Agreement") with the San Diego State University Foundation, a California non-profit corporation (the "Developer"). As a property owner, tenant or person who has requested notice, you should know that the Planning Commission will hold a public hearing to approve, conditionally approve, or deny an application for a Tentative Map to convert 42 existing residential units into condominiums and waive the requirement to underground existing overhead utility lines on a 3.09 acre site in the RM-1-1 and OR-1-1 Zone of the Central Urbanized Planned District within the City Heights Neighborhood Element of the Mid-City Communities Plan Area. A RESOLUTION PURSUANT TO SECTION 147(f) OF
THE INTERNAL REVENUE CODE OF 1986
APPROVING THE ISSUANCE OF BONDS BY THE HOUSING AUTHORITY OF THE CITY OF SAN DIEGO FOR THE SYCAMORE ESTATES
APARTMENTS PROJECT.
WHEREAS, the Housing Authority of the City of San Diego [the Authority] adopted a resolution that constituted a declaration of official intent to issue not to exceed $12 million aggregate principal amount of multifamily housing revenue bonds [the Bonds] to finance the acquisition and construction of the approximately 106 units of multifamily rental housing to be located at the intersection of Stonebridge Parkway and Sycamore Trail, San Diego, California 92040, as described in the form of notice of public hearing attached as Exhibit "A" [the Project]; and
WHEREAS, in order for interest on the Bonds to be tax-exempt, Section 147(f) of the Internal Revenue Code of 1986, requires that of the Bonds be approved by the City Council as the applicable elected representative after a public hearing following reasonable public notice; and
WHEREAS, notice of a public hearing with respect to the proposed issuance of
the Bonds was published in a newspaper of general circulation in the City on January 3, 2005; and
WHEREAS, the hearing was held on January 18, 2005, and an opportunity was
provided for interested persons to express their views on the issuance of the Bonds and
on the nature and location of the Project;
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of San Diego that this City Council, as the applicable elected representative under Section 147(f) of the Code, approves the issuance of the Bonds by the Authority for the Project.
BE IT FURTHER RESOLVED, that the City does not warrant the
creditworthiness of the Bonds or guarantee, in any way, the payment of the Bonds. No
moneys of the City will be pledged or applied to the payment of the Bonds.

Exhibit "A" [Project]; and
WHEREAS, the Authority adopted a resolution that constituted a declaration of official intent to issue not to exceed $400,000 aggregate principal amount of multifamily housing revenue bonds [Bonds] as a second series of bonds to finance a portion of the acquisition and construction of the Project, and
WHEREAS, in order for interest on the Bonds to be tax-exempt, Section 147(f) of the Internal Revenue Code of 1986 requires that the Bonds be approved by the City Council as the applicable elected representative after a public hearing following reasonable public notice; and
WHEREAS, notice of a public hearing with respect to the proposed issuance of the Bonds was published in a newspaper of general circulation in the City on January 17, 2005; and
WHEREAS, the hearing was held on February 15, 2005, and an opportunity was provided for interested persons to express their views on the issuance of the Bonds and on the nature and location of the Project;
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of San Diego that this City Council, as the applicable elected representative under Section 147(f) of the Code, approves the issuance of the Bonds by the Authority.
