PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:


To consider approval of ordinances amending Municipal Code Chapter 5, Article 4; Chapter 6, Article 12; Chapter 9, Article 8; Chapter 11, Articles 2-3; Chapter 12, Articles 1, 3, and 5-9; Chapter 13, Articles 1 and 2; Chapter 14, Articles 1-4; and Chapter 15, Articles 5-6, 10, 13 and 17 relating to the 9th Update.
The 9th Update is a package of code amendments that are being processed in accordance with the City's Land Development Code work program. There are 57 amendment issues; the bulk of which is regulatory reform. Significant items include amendments to streamline the permit process for various types of development, to implement the City's economic development strategy in support of local industry, and to incorporate efficiencies in the processing of environmental documents and permits for minor improvements to development older than 45 years old (that is not designated a historic resource). The proposal also amends the regulations related to previously conforming development.

On January 29, 2015, the Planning Commission recommended approval of the 9th Update (vote 6-1), including amended language as follows: Issue #23 (to allow beverage and food manufacturing in IP-1-1, not in IP-3-1), Issue #25 (to allow distribution facilities in IP-1-1 only in Otay Mesa), Issue #27 (to remove the amortization on drive-through hours), and Issue #28 (to remove LDC Section 141.0302(j) in order to allow access to a companion unit from an unimproved alley).

An Environmental Impact Report (EIR No. 96-0333) was prepared, and certified on November 18, 1997 for the original project, the adoption of the Land Development Code. It was determined in accordance with Public Resources Code Section 21166 and California Environmental Quality Act (CEQA) Guidelines Section 15162(a) that: (1) no substantial changes are proposed to the project which would require major revisions of the previous EIR; (2) no substantial changes occur with respect to the circumstances under which the project is undertaken that would require any revisions to the previous EIR; and (3) there is no new information of substantial importance that was not known and could not have been known at the time the previous EIR's were certified. Therefore, no subsequent EIR or other environmental document is needed for the 9th Update, as all of the impacts were adequately addressed and disclosed in EIR No. 96-0333. For a more detailed analysis, refer to CEQA 15162 Evaluation, Memorandum dated December 24, 2014.

In accordance with state law, following City Council action, the City will be required to submit the ordinances to the San Diego County Regional Airport Authority for a determination that they are consistent with applicable Airport Land Use Compatibility Plans. The amendments will not be effective until the Airport Authority determines the amendments are consistent with adopted ALUCPs, or the City processes an overrule.

The ordinance is intended to apply within the coastal zone; therefore the City Council's decision requires amending the City's Local Coastal Program. As such, the final decision for areas located within the coastal zone will be with the California Coastal Commission. The City of San Diego will submit the ordinances for certification following City Council and Airport Authority action. The ordinance will not be effective in the coastal zone until the Coastal Commission unconditionally certifies the amendment.

Copies of the draft amendments are available for viewing at the City of San Diego, Development Services Department, 1222 First Avenue, San Diego, CA 92101, 5th Floor. Materials for this item will be posted 72 hours prior to the public hearing with the City Council docket at www.sandiego.gov/city-clerk/.

Process 5 amendments to the Municipal Code (Chapter 12, Article 6, Division 5; Chapter 13, Article 1, Division 4; Chapter 14 Article 2, Divisions 4 and 5; Chapter 14, Article 3, Division 3; Chapter 15, Article 1, Division 1) and the City's Local Coastal Program regarding small lot subdivisions. This amendment package would create new regulations that would allow for the subdivision of specified multi-family zones into small lots, consistent with base zone density, for the purpose of developing single-family residences without the need for home owners' associations. A decision on an application for a small lot subdivision would be subject to a Site Development Permit Process Three.

On January 29, 2015 the San Diego Planning Commission recommended the City Council approve the ordinance for small lot subdivisions, as presented, by a vote of 6-1.

The proposed amendments to the Municipal Code constitute an amendment to City of San Diego's Local Coastal Program (LCP) and must be certified by the California Coastal Commission to be effective within the City's Coastal Overlay Zone. The LCP amendment for these amendments will not become effective until unconditionally certified by the California Coastal Commission. The easements were to allow for the temporary construction, repair, and maintenance of slopes and drainage facilities, associated with the construction of Vista Sorrento Parkway and Mira Sorrento Place. The project site is located at the northeast corner of Vista Sorrento Parkway and Mira Sorrento Place, north of Mira Mesa Boulevard in the RS-1-8 Zone of the Mira Mesa Community Plan area within Council District 6.

The final decision by the City of San Diego is not appealable to the California Coastal Commission. If you want to receive a Notice of Final Action, you must submit a written request to the City Project Manager listed above.

This project was determined to be categorically exempt from the California Environmental Quality Act on January 9, 2015 and the opportunity to appeal that determination ended January 26, 2015.

The project proposes to change the name of Lise Avenue to Lakiba Palmer Avenue by the family of Lakiba Palmer. This street name change project is located east of Interstate 805, south of Interstate 94 and north of Market Street. Lise Avenue is approximately 1,200 feet in length and serves approximately 34 single-family homes within a residential neighborhood in the Southeast San Diego Planned District SF-5000 Zone and the Encanto Community Plan. Lakiba Palmer was killed on October 12, 2000, while serving on the USS Cole in Yemen and received the Purple Heart Medal. She was a graduate of San Diego High School and resided with her family at 5001 Lise Avenue. This proposed street name change was deemed complete on February 9, 2015, reviewed by staff and found to comply with all the criteria established by San Diego Municipal Code Section 125.01120.

This activity is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15060 (c)(3).

The decision of the City Council is final.
