As a property owner, tenant, or person who has requested notice, you are hereby notified the Hearing Officer of Civic San Diego ("CivicSD") will hold a public hearing to either approve, conditionally approve, or deny an application for a Process Three Conditional Use Permit (CUP) amendment to allow for extended sale hours of alcoholic beverages for off-site consumption at Rite Aid located at 1411 Kettner Boulevard, San Diego, CA, 92101, in the Little Italy neighborhood of the Downtown Community Plan Area.

The decision of the CivicSD Hearing Officer is final unless appealed to the CivicSD Board of Directors. In order to appeal the decision you must be present at the public hearing and file a Speaker's Slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. The appeal application may be obtained from CivicSD located at 401 B Street, Suite 400, San Diego, California, 92101. The appeal must be made within ten (10) business days of the Hearing Officer's decision. If the Hearing Officer's decision is appealed, the decision made by the CivicSD Board of Directors is the final decision.

This activity is covered under the Final Environmental Impact Report (FEIR) for the San Diego DCP, CCPDO, and 10th Amendment to the Centre City Redevelopment Plan, certified by the former Redevelopment Agency ("Former Agency") and the City Council on March 14, 2006 (Resolutions R-04001 and R-301265, respectively) and subsequent addenda to the FEIR certified by the Former Agency on August 3, 2007 (Former Agency Resolution R-04193), April 21, 2010 (Former Agency Resolution R-04510), and August 3, 2010 (Former Agency Resolution R-04544), and certified by the City Council on February 12, 2014 (City Council Resolution R-308724) and July 14, 2014 (City Council Resolution R-309115). The FEIR is a "Program EIR" prepared in compliance with California Environmental Quality Act (CEQA) Guidelines Section 15168. The project is within the scope of the development program described in the FEIR; therefore, no further environmental documentation is required under CEQA.

If you wish to challenge either CivicSD's or the City of San Diego's action on the above proceeding in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written correspondence to CivicSD at or before the public hearing.
