NOTICE OF ABANDONED, LOST, OR STOLEN PROMISSORY NOTE; REWARD OF $1,000 BY BORROWER/TRUSTOR TO THE “NOTE HOLDER” FOR PRODUCTION AND INSPECTION THEREOF. APN: 485-421-05-00; “FAILED BANK” WASHINGTON MUTUAL LOAN NO: Xxxxxx372-1; ADJUSTIBLE RATE NOTE NO: Xx-xxxx-xxxxx0372-1; DEED OF TRUST DOC#: 2005-0403332; ALLEGED NOTICE OF DEFAULT DOC#: 10-0098507
Whereas on May 9, 2005 in El Cajon, California, Borrower/Trustor Mary Ellen Harshberger, herein after “B/T”, executed an eight page (8) page Adjustable Rate Note in the amount “$352,400.00”, herein after the “Note”, and a Deed of Trust also executed on May 9, 2005 thereafter recording May 12, 2005 in the office of the County Recorder, San Diego County, California. B/T therein identified the Lender/Beneficiary as “Washington Mutual” and “California Reconveyance Company” was duly appointed Trustee. Note was last seen by B/T in El Cajon, California, on May 9, 2005. On September 25, 2008 Washington Mutual became “Failed Bank Washington Mutual” pursuant to Receiver FDIC “PURCHASE AND ASSUMPTION AGREEMENT”. B/T subsequently received notice from third party debt collector JP Morgan Chase the Failed Bank Washington Mutual Loan would be “Serviced” by JP Morgan Chase beginning October 25, 2009. During the month of October 2009 B/T served both Failed Bank Washington Mutual and JP Morgan Chase with a Real Estate Settlement Procedures Act “Qualified Written Request” requesting production for B/T's inspection the unaltered original wet inked Note therein quoting at paragraph one of said Note, 'BORROWERS PROMISE TO PAY . . . The Lender or anyone who takes this Note by transfer and who is entitled to receive payments under this Note is called the “Note Holder” '. As of the date of this Notice both Failed Bank Washington Mutual and JP Morgan Chase have failed to produce said Note and are in default of said Qualified Written Request. Also, as of the date of this Notice B/T has neither notice of any change in beneficiary, notice of any transfer of the Note, nor has any other document been recorded in San Diego County under said APN aside from the alleged Notice of Default by said Trustee.
Now therefore B/T suspects said Note may have been abandoned, lost, or stolen and hereby offers a $1,000 cash reward to the Note Holder for the production, for B/T's inspection, of said Note. B/T shall consider failure of said Note Holder to come forward with said Note within sixty (60) business days publication of this Notice to constitute Abandonment of the Note and Abandonment of any and all rights secured thereon by the Note to the Note Holder.

NOTICE IS HEREBY GIVEN that the Redevelopment Agency of the City of San Diego (the “Agency”) has scheduled a public hearing for April 13, 2010, at the hour of 2:00 p.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to Section 33431 of the California Health and Safety Code, for the purpose of considering a proposed First Amendment to the Park-It-On-Market Lease by and between the Agency and Max Levy and Brad Levy dba Allen's Flowers and Plants, Inc. (collectively and jointly and severally, “Lessee”), for the property owned by the Agency and located within the East Village Redevelopment District of the Centre City Redevelopment Project Area in the City of San Diego, State of California.
The original Lease commenced on November 5, 2009, and is effective for a period of five (5) years, subject to two (2) options to extend the term of the Lease each for an additional five (5) years. The Lease provides for the lease of real property to Lessee consisting of a retail space of approximately 1,744 square-feet (“Leased Premises”) located on the ground floor of the 500-space Park-it-on-Market parking facility (the “Parkade”) at 620 Market Street between Sixth and Seventh Avenues fronting on Market Street in the City of San Diego. Lessee has requested a First Amendment to the Lease for the purpose of including as a part of the Leased Premises approximately 320 additional square feet of space known as the “mechanical cage” located on the first floor of the Parkade above the tenant space for the installation of a condenser for Lessee's in-store refrigerator.
The City of San Diego (the “City”) serves as the Agency's agent for the purpose of managing the operations of the Parkade, including the Leased Premises.
The purpose of the hearing is for the Agency to consider the proposed First Amendment to the Park-It-On-Market Lease between Lessee and the Agency.
The proposed First Amendment to the Park-It-On-Market Lease is available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the office of the Redevelopment Agency, 1200 Third Avenue, Suite 1400, San Diego, California, 92101, at the Office of the City Clerk, 202 C Street, City Administration Building, 2nd Floor, San Diego, California 92101, and the office of the Centre City Development Corporation, 401 B Street, Suite 400, San Diego, California 92101.
At any time before the date and time set forth above for the public hearing by the Agency, written comments on or objections to the proposed First Amendment to the Lease may be filed with the City Clerk. Comments may also be submitted during such period on the other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the public hearing will be given an opportunity to appear and be so heard. The decision of the Agency is final. If you later desire to challenge actions of the Agency in connection with this transaction, you could be limited to raising issues you or someone else raised at the public hearing, or in written correspondence to the Agency at or prior to the public hearing.

Proposed Amendments to the Downtown Community Plan
Includes modifications and additions to policies and goals in Chapter 9 (Historic Preservation) and the addition of an Appendix A to contain the Mitigation, Monitoring and Reporting Program (MMRP) from the 2006 Final Environmental Impact Report (FEIR) certified by the Redevelopment Agency (including revisions described below).

Includes the addition of the parking standards for commercial and residential developments, consistent with the parking standards adopted in 2006 within the Centre City Planned District Ordinance.
Proposed Revisions to the Mitigation Monitoring and Reporting Program (MMRP) to the 2006 Final Environmental Impact Report (FEIR) for the Downtown Community Plan, Centre City Planned District Ordinance, and Redevelopment Plan for the Centre City Project Area
Includes refinements to the Mitigation Measures for potential impacts to historical, archaeological and paleontological resources to better reflect City of San Diego requirements and practices.
