ORDINANCE NUMBER O-19159 (NEW SERIES)

AN ORDINANCE OF THE COUNCIL OF THE CITY OF
SAN DIEGO AMENDING CHAPTER 6, ARTICLE 3,
DIVISION 0 OF THE SAN DIEGO MUNICIPAL CODE
BY AMENDING SECTION 63.30 RELATING TO THE
UTILIZATION OF THE ENVIRONMENTAL GROWTH
FUND.
This ordinance makes changes to the City of San Diego's laws pertaining to the Utilization of the Environmental Growth Fund. This amendment contains clarification that should the City Manager determine that anticipated revenues in any fiscal year will be insufficient to maintain existing City services necessary for preserving and enhancing the environment, the City Manager may ask the City Council to temporarily suspend compliance with this Section for the upcoming fiscal year in order to allow Environmental Growth Funds to be allocated consistent with San Diego Charter section 103.1a.
This ordinance also contains a notice that the City Council hereby finds that anticipated revenues in this fiscal year are insufficient and for next fiscal year are anticipated
to be insufficient to maintain existing City services necessary for preserving and enhancing
the environment; therefore, the City Council does hereby temporarily suspend compliance
with San Diego Municipal Code section 63.30 for Fiscal Year 2002-2003 and for Fiscal Year 2003 2004.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, since a written or printed copy will be available to the City Council and the public a day prior to its final passage.
This ordinance shall take effect and be in force on the thirtieth day from and after its passage.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN DIEGO PURSUANT TO SECTION 99 OF THE CITY CHARTER AUTHORIZING A FACILITIES LEASE AND SITE LEASE WITH THE SAN DIEGO FACILITIES AND EQUIPMENT LEASING CORPORATION, AND A TRUST AGREEMENT, AND APPROVING THE FORM OF AN ASSIGNMENT AGREEMENT RELATING TO THE DELIVERY OF CERTIFICATES OF PARTICIPATION IN AN AMOUNT NOT TO EXCEED $22,000,000 FOR A TERM NOT EXCEEDING 32 YEARS (1993 BALBOA PARK/MISSION BAY PARK REFUNDING), AND SUCH OTHER NECESSARY ACTIONS IN CONNECTION THEREWITH.
The City hereby authorizes and approves a Trust Agreement, a Facilities Lease, a Site Lease, the form of an Assignment Agreement, and Certificates of Participation, on file in the office of the City Clerk as Document Nos. OO- 19161 -1, OO- 19161 -2, OO- 19161 -3, OO- 19161 -4, and OO- 19161 -5.

AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN DIEGO PURSUANT TO SECTION?99 OF THE CITY CHARTER RELATING TO THE REFUNDING OF CERTAIN LEASE FINANCE OBLIGATIONS RELATED TO THE OLD TOWN LIGHT RAIL TRANSIT EXTENSION, AUTHORIZING A LEASE AGREEMENT WITH THE CITY OF SAN DIEGO/MTDB AUTHORITY, A SUBLEASE AGREEMENT WITH THE SAN DIEGO METROPOLITAN TRANSIT DEVELOPMENT BOARD, AND THE AUTHORIZATION FOR THE CITY OF SAN DIEGO/MTDB AUTHORITY TO ISSUE ITS LEASE REVENUE REFUNDING BONDS IN AN AMOUNT NOT TO EXCEED $18.5 MILLION.
The City hereby authorizes and approves a lease agreement with the City of San Diego/ MTDB Authority, and a sublease agreement with the San Diego Transit Development Board, on file in the office of the City Clerk as Document Nos. OO- 19162 -1 and OO- 19162 -2. The City hereby authorizes the issuance of $18.5 million in lease revenue refunding bond.
