Pursuant to the Order Directing Issuance of Notice and Restraining Prosecution of Claims, and the Order Granting Ex Parte Application for Injunction Staying State Court Action, both executed on February 7, 2008 by Judge Jeffrey T. Miller of the United States District Court, Southern District of California in the case entitled In the Matter of the Complaint of Mission Bay Jet Sports, LLC, A California Limited Liability Corporation; and Robert Adamson, individually and doing business as Mission Bay Jet Sports, for Exoneration from or Limitation of Liability, bearing case number 08-CV 0146 JM (CAB): NOTICE IS HEREBY GIVEN THAT
plaintiffs MISSION BAY JET SPORTS, LLC and ROBERT ADAMSON, individually and doing business as, MISSION BAY JET SPORTS, as owner of a certain 2007 Bombardier Sea-Doo water craft (hull no. YDV09441C707, and hereinafter referred to as the vessel), have filed a complaint pursuant to Title 46 of the United States Code, Sections 30505 et seq., Federal Rule of Civil Procedure 9(h), and Rule F of the Supplemental Rules for Admiralty and Maritime Claims of the Federal Rules of Civil Procedure, claiming the right to exoneration from or limitation of liability for all claims allegedly resulting from a casualty which occurred on or about July 29, 2007, while the vessel was operating on the navigable waters of Mission Bay, San Diego, California, the facts of which a more fully set forth in the complaint.
All persons asserting claims with respect to which the complaint seeks limitation are admonished to file their respective claims with the Clerk of this Court and to serve on the attorneys for the plaintiff, Rocky K. Copley, Esq. of the Law Office of Rocky K. Copley, at 550 West C Street, Suite 1150, San Diego, CA 92101 a copy thereof on or before March 28, 2008,
or 30 days from the date of the issuance of this notice, whichever is latest in time, pursuant to Rule F(4) of the Supplemental Rules for Certain Admiralty and Maritime Claims of the Federal Rules of Civil Procedure, or be defaulted. Personal attendance is not required.
Any claimant desiring to contest either the right to exoneration from or the right to limitation of liability shall file and serve an answer to the complaint unless his claim has included an answer.
