As a property owner, tenant, or person who has requested notice, you should know that the Planning Commission will hold a public hearing to recommend approval, conditional approval, or denial to the City Council of amendments to the Municipal Code (Chapter 11, Article 3, Divisions 1 and 2; Chapter 13, Article 1, Divisions 2, 3, 4, 5, and 6; Chapter 14, Article 2, Divisions 5; and Chapter 15, Article 2, Division 3; Chapter 15, Article 5, Division 2; Chapter 15, Article 10, Division 3; and Chapter 15, Article 12, Division 3) and the City's Local Coastal Program regarding the community plan implementation ordinance. This amendment has been developed to provide additional land use tools to implement the community plan update process for several community plans. Generally, the ordinance creates new mixed use commercial zones that allow for increased residential density, a new townhouse zone, new office zones that prohibit residential use, and a new residential use of "Shopkeeper" to be permitted in residential/commercial mixed use zones; expands the types of commercial uses currently permitted in specified multi-family zones, and removes limitations on the amount of ground floor commercial; and creates an exception for calculating height for mixed use buildings 45 feet in height and greater. The amendments are subject to Process 5.

The decision to approve, conditionally approve, modify, or deny the amendments to the Municipal Code and the City's Local Coastal Program will be made by the City Council at a future public hearing. A separate notice of public hearing will be provided 10 business days prior to the City Council hearing for this item. Following City Council action, the City of San Diego will submit the ordinance to the Airport Land Use Commission for a consistency determination. The code amendments will not be effective until the Airport Land Use Commission determines the City's ordinance is consistent with the adopted ALUCPs.

The ordinance would apply within the Coastal Zone; therefore the City Council's decision requires amending the City's Local Coastal Program. As such, the final decision for areas located within the Coastal Overlay Zone will be with the California Coastal Commission. The City of San Diego will submit the ordinance for certification to the California Coastal Commission following City Council and Airport Land Use Commission actions. The ordinance will not be effective in the Coastal Overlay Zone until the California Coastal Commission unconditionally certifies the amendment.

This amendment incorporates Assembly Bill 2222 (AB-2222), which went into effect on January 1, 2015, adds modifications suggested by the California Coastal Commission, and includes clarifications and minor modifications deemed necessary to more accurately reflect state density bonus law. The amendments are subject to Process 5.

The decision to approve, conditionally approve, modify, or deny the amendments to the Municipal Code and the City's Local Coastal Program will be made by the City Council at a future public hearing. The Regional Transportation Congestion Improvement Program (RTCIP) provides for the collection of a fee per new dwelling unit to ensure future development contributes its proportional share of the funding needed to pay for the Regional Arterial System (RAS) and related transportation and transit facility improvements, as defined in SANDAG's most recently adopted Regional Transportation Plan (RTP). Council action is to approve a 2.5% increase to the fee; as provided for in the TransNet Extension Ordinance which requires no less than a 2% increase per year. The report and relevant documents are available for public inspection at the Office of the City Clerk, City Administration Building, 2nd Floor, 202 "C" Street, San Diego, California, 92101.

The decision of the City Council is Final.
