AN ORDINANCE AMENDING
 ANNUAL BUDGET FOR FISCAL YEAR 2005-2006

WHEREAS, on 21 June 2005, pursuant to Ordinance 2345, the Board of Port Commissioners (Board) of the San Diego Unified Port District (District) adopted the Annual Budget for the operation of the District for Fiscal Year 2005-2006, as amended; said Annual Budget is on file in the office of the District Clerk as Document Nos. 49229, 49906, 50043, 50114, 50115 and 50116; and
  WHEREAS, the District desires to amend said Annual Budget to incorporate actions approved by the Board at its meting held on December 6, 2005, to incorporate the internal transfer of funds between expenditure categories, and to amend the Harbor Police Department's authorized staffing positions; and
  WHEREAS, the District desires to amend the Ordinary Annual Expenses portion of said budget by decreasing the amount authorized by Ninety Nine Thousand Nine Hundred Dollars ($99,900.00); and
  WHEREAS, the District desires to further amend the Capital Outlay portion of said budget by increasing the amount authorized by One Hundred Twenty Five Thousand Dollars ($125,000.00); and
  WHEREAS, the District desires to further amend said budget by increasing the amount authorized for the Equipment Outlay portion of said budget by Twelve Thousand Dollars ($12,000.00); and
  WHEREAS, the District desires to further amend said budget by increasing the amount authorized for the Public Arts Projects portion of said budget by Sixteen Thousand Five Hundred Dollars ($16,500.00); and
  WHEREAS, the District desires to further amend said budget by decreasing the number of Public Safety Dispatch Supervisor positions in the Harbor Police Department from Two (2) to One (1), and increasing the number of Lieutenant positions in said Harbor Police Department from Five (5) to Six (6), NOW, THEREFORE,

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.That the Annual Budget for Fiscal Year 2005-2006 is hereby amended by decreasing the amount of funds previously appropriated for Ordinary Annual Expenses by Ninety Nine Thousand Nine Hundred Dollars ($99,900.00); increasing the amount of funds previously appropriated for Capital Outlay by One Hundred Twenty Five Thousand Dollars ($125,000.00); increasing the amount of funds previously appropriated for Equipment Outlay by Twelve Thousand Dollars ($12,000.00), and increasing the amount of funds previously appropriated for Public Arts Projects by Sixteen Thousand Five Hundred Dollars ($16,500.00), for a net budget increase of Fifty Three Thousand Six Hundred Dollars ($53,600.00), as follows:

 Section 2. That the Annual Budget for Fiscal Year 2005-2006 is hereby further amended by amending the Harbor Police Department Position Summary, by decreasing the number of Public Safety Dispatch Supervisor positions from Two (2) to One (1), and increasing the number of Lieutenant positions in said Harbor Police Department from Five (5) to Six (6).
Section 3. This ordinance is declared to take effect upon its publication, pursuant to the provisions of Section 21 of the San Diego Unified Port District Act.

 AN ORDINANCE AUTHORIZING
 AN OPTION TO LEASE AGREEMENT
 WITH SAN DIEGO INTERNATIONAL TERMINALS, INC.

The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
Section 1.The San Diego Unified Port District hereby grants an Option to Lease Agreement and authorizes the Executive Director or his authorized representative to execute said Option to Lease Agreement with San Diego International Terminals, Inc., a California Subchapter S corporation, to lease certain District premises of approximately 103,452 square feet of land area located on the Tenth Avenue Marine Terminal at the southerly end of Water Street in the City of San Diego, plus the preferential, non-exclusive use of the south side of the Commercial Berthing Pier located near the leased premises, for the construction and operation of a facility within the Tenth Avenue Marine Terminal for importation, storage and distribution of sand and gravel and for no other purpose whatsoever.  The Option to Lease Agreement is for a term of Twelve (12) calendar months commencing on the first day of the calendar month following by month in which the Board of Port commissioners authorizes the granting of said Option Agreement, provided, however, said Option to Lease Agreement is subject to earlier termination in accordance with the terms, covenants and conditions contained therein, on file in the office of the District Clerk as Document No. 50554.
 Section 2. Upon timely performance and exercise of said Option to Lease Agreement, the Executive Director or his authorized representative is hereby directed to execute the Lease with San Diego International Terminals, Inc., which is attached to said Option to Lease Agreement.
Section 3. This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners; provided, however, in the event San Diego International Terminals, Inc. does not satisfy the conditions set forth in Paragraph 5 of the Option to Lease Agreement, entitled Conditions Precedent, said Option to Lease Agreement shall be null and void and of no further force or effect.

MOBILE PASSENGER GANGWAY SYSTEM

The San Diego Unified Port District seeks proposals from qualified firms to provide a Mobile Passenger Gangway System. The District's estimate for this project is approximately $400,000.00 to $600,000.00.
