Title: First Amendment to Park-It-On-Market Lease by and between the Redevelopment Agency of the City of San Diego and Max Levy and Brad Levy (dba Allen's Flowers and Plants, Inc.) which adds approximately 320 square feet to the Leased Premises under the Lease of a 1,744 square-foot site located at 620 Market Street in the East Village Redevelopment District of the Centre City Redevelopment Project.

NOTICE IS HEREBY GIVEN that the Redevelopment Agency of the City of San Diego (the “Agency”) has scheduled a public hearing for April 13, 2010, at the hour of 2:00 p.m. or as soon thereafter as the matter can be heard, in the City Council Chambers, 12th Floor, City Administration Building, 202 C Street, San Diego, California, pursuant to Section 33431 of the California Health and Safety Code, for the purpose of considering a proposed First Amendment to the Park-It-On-Market Lease by and between the Agency and Max Levy and Brad Levy dba Allen's Flowers and Plants, Inc. (collectively and jointly and severally, “Lessee”), for the property owned by the Agency and located within the East Village Redevelopment District of the Centre City Redevelopment Project Area in the City of San Diego, State of California.
The original Lease commenced on November 5, 2009, and is effective for a period of five (5) years, subject to two (2) options to extend the term of the Lease each for an additional five (5) years. The Lease provides for the lease of real property to Lessee consisting of a retail space of approximately 1,744 square-feet (“Leased Premises”) located on the ground floor of the 500-space Park-it-on-Market parking facility (the “Parkade”) at 620 Market Street between Sixth and Seventh Avenues fronting on Market Street in the City of San Diego. Lessee has requested a First Amendment to the Lease for the purpose of including as a part of the Leased Premises approximately 320 additional square feet of space known as the “mechanical cage” located on the first floor of the Parkade above the tenant space for the installation of a condenser for Lessee's in-store refrigerator.
The City of San Diego (the “City”) serves as the Agency's agent for the purpose of managing the operations of the Parkade, including the Leased Premises.
The purpose of the hearing is for the Agency to consider the proposed First Amendment to the Park-It-On-Market Lease between Lessee and the Agency.
The proposed First Amendment to the Park-It-On-Market Lease is available for public inspection and copying during regular office hours (8:00 a.m. to 5:00 p.m., Monday through Friday) at the office of the Redevelopment Agency, 1200 Third Avenue, Suite 1400, San Diego, California, 92101, at the Office of the City Clerk, 202 C Street, City Administration Building, 2nd Floor, San Diego, California 92101, and the office of the Centre City Development Corporation, 401 B Street, Suite 400, San Diego, California 92101.
At any time before the date and time set forth above for the public hearing by the Agency, written comments on or objections to the proposed First Amendment to the Lease may be filed with the City Clerk. Comments may also be submitted during such period on the other documents referred to in this Notice. All persons wishing to question, comment, object to, or be heard on such matters at the public hearing will be given an opportunity to appear and be so heard. The decision of the Agency is final. If you later desire to challenge actions of the Agency in connection with this transaction, you could be limited to raising issues you or someone else raised at the public hearing, or in written correspondence to the Agency at or prior to the public hearing.
