The City of San Diego Land Development Review Division has prepared a draft MITIGATED NEGATIVE DECLARATION for the following project and is inviting your comments regarding the adequacy of the document. Your comments must be received by April 22, 2006 to be included in the final document considered by the decision-making authorities. Subject: Wisteria. SITE DEVELOPMENT PERMIT (SDP) and VESTING TENTATIVE MAP (Process 4) to construct a 3-story office building (Building A); three 3-story shopkeeper units (Building B); and two 4-story condominium buildings (Buildings C and D) for a total of 35,258 square feet of commercial space and 114 residential units, including 12 affordable units, and associated parking. In addition, the SDP would allow the encroachment of private storm drains into Erma Road. The vacant 3.92 acre site is located at 9889 Erma Road in the CO-1-2 Zone within the Scripps Miramar Ranch Community Plan and Council District 5. AN ORDINANCE AMENDING CHAPTER 5, ARTICLE 4, DIVISION 2, OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 54.0212 REGARDING ABANDONED PERSONAL PROPERTY

This ordinance increases to $100 the value of unidentifiable, abandoned personal property found on public property that must be transferred to the San Diego Police Department for handling and potential sale pursuant to San Diego Municipal Code section 22.0603, and eliminates the requirement for interim storage prior to transfer to the San Diego Police Department.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, since a written or printed copy will be available to the City Council and the public a day prior to its final passage.
This ordinance shall take effect and be in force on the thirtieth day from and after its final passage.

WHEREAS, under Charter section 280(a)(2) this ordinance is not subject to veto by the Mayor because this matter requires the City Council to act as a quasi-judicial body and where a public hearing was required by law implicating due process rights of individuals affected by the decision and where the Council was required by law to consider evidence at the hearing and to make legal findings based on the evidence presented; NOW, THEREFORE,
BE IT ORDAINED, by the Council of the City of San Diego, as follows:
Section 1. That 2.2 acres located at the northwest corner of Poway Road and Creekview Drive, and legally described as being Lot 3 of Savannah Terrace, Areas 15, 16, 17 and 18, Map Number 14740, recorded in the office of the County Recorder of San Diego on February 9, 2004, in the City of San Diego, County of San Diego, State of California, in the Sabre Springs Community Plan area, in the City of San Diego, California, as shown on Zone Map Drawing No. B-4228, filed in the office of the City Clerk as Document No. OO- 19470 , are rezoned from the CC-1-3 zone (previously referred to as the CA zone) into the RM-2-5 zone (previously referred to as the R-1500 zone), as the zone is described and defined by San Diego Municipal Code section 131.0406; and that 2.5 acres located at the southeast corner of Poway Road and Springhurst Drive, and legally described as Parcel 1 of Parcel Map No. 17982, recorded January 30, 1998 in the Office of the County Recorder of San Diego, in the City of San Diego, County of San Diego, State of California in the Sabre Springs Community Plan area, in the City of San Diego, California, as shown on Zone Map Drawing No. B-4228, filed in the office of the City Clerk as Document No. OO- 19470 , are rezoned from the RM-1-1 zone (previously referred to as the R-3000 zone) into the CC-1-2 zone (previously referred to as the CN zone), as the zone is described and defined by San Diego Municipal Code section 131.0502..
Section 2. That Ordinance Nos. O 15806 (New Series) and O-18381 (New Series), adopted August 23, 1982 and February 10, 1997, respectively, of the ordinances of the City of San Diego is repealed insofar as the same conflict with the rezoned uses of the land.
Section 3. That a full reading of this ordinance is dispensed with prior to its final passage, a written or printed copy having been available to the City Council and the public a day prior to its final passage.
Section 4. That this ordinance shall take effect and be in force on the thirtieth day from and after its passage, and no building permits for development inconsistent with the provisions of this ordinance shall be issued unless application therefore was made prior to the date of adoption of this ordinance.
