A RESOLUTION DECLARING THE RESULTS OF THE
MUNICIPAL SPECIAL ELECTION HELD IN COUNCIL
DISTRICT 4 IN THE CITY OF SAN DIEGO ON
MARCH 26, 2013

WHEREAS, a Municipal Special Election was held in Council District 4 in the City of
San Diego on Tuesday, March 26, 2013, pursuant to the provisions of Ordinance No. 0-20232 (New Series), introduced and adopted on January 7, 2013, for the purpose of electing candidates to the office of Councilmember for District 4; and

WHEREAS, a copy of the certificate of the Registrar of Voters of San Diego County canvassing the returns of the Municipal Special Election, as certified to the City Clerk, has been duly received; and

WHEREAS, the City Clerk has certified the results to the City Council; and

WHEREAS, declaring the results of the election as certified by the Registrar of Voters and the City Clerk is a ministerial act required by California Elections Code section 10263 and, therefore, is not subject to veto by the Mayor; NOW, THEREFORE,

BE IT RESOLVED, by the Council of the City of San Diego, that the Council finds and determines, pursuant to the provisions of Section 27.0411 of the San Diego Municipal Code, as follows:

I

The total number of votes cast in the Municipal Special Election was 13,322.

II

The total vote received by each candidate at the Municipal Special Election is as follows:

FOR COUNCIL DISTRICT 4 (filling the vacancy in the term previously held by
Anthony Young):

MYRTLE COLE 4,304 VOTES (32.31%)
DWAYNE CRENSHAW 2,025 VOTES (15.20%)
BRIAN “BARRY” POLLARD 1,548 VOTES (11.62%)
RAY SMITH 1,207 VOTES (9.06%)
BLANCA LOPEZ BROWN 1,084 VOTES (8.14%)
SANDY SPACKMAN 1,067 VOTES (8.01%)
BRUCE WILLIAMS 1,059 VOTES (7.95%)
TONY VILLAFRANCA 621 VOTES (4.66%)
MONICA MONTGOMERY 404 VOTES (3.03%)

Total 13,322 VOTES (100%)

Myrtle Code and Dwayne Crenshaw are hereby declared to be the two candidates receiving the highest number of votes and will advance to the Special Run-off Election.

The City Clerk shall make public the results of the canvass of the Municipal Special Election by publication of a copy of this resolution.

Passed by the Council of The City of San Diego on March 28, 2013, by the following vote.

YEAS: LIGHTNER, FAULCONER, GLORIA, KERSEY, ZAPF, SHERMAN.

NAYS: NONE.

AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 6,
DIVISION 9 OF THE SAN DIEGO MUNICIPAL CODE BY
AMENDING SECTIONS 26.0901, 26.0902, 26.0904, 26.0905,
26.0906, 26.0907, 26.0908, 26.0909, AND 26.0910, RELATING
TO THE HUMAN RELATIONS COMMISSION.

This ordinance amends Chapter 2, Article 6, Division 9, of the San Diego Municipal Code by amending Sections 26.0901, 26.0902, 26.0904, 26.0905, 26.0906, 26.0907, 26.0908, 26.0909, and 26.0910 relating to the Human Relations Commission (Commission) by updating the language regarding the list of protected classes to comply with current applicable federal, state, or local laws; increasing the total number of Commissioners from fifteen to seventeen by increasing from seven to eight the number of appointments made directly by the Mayor and increasing from eight to nine the number of appointments made from a list of up to three nominations submitted by each Councilmember because the Council is expanding from eight to nine and to maintain an odd total for vote counts; updating the original, outdated appointment timeframes; increasing the Commission Chair's term limit from two to three years; consolidating the sections regarding the Commission's annual reports to the Council and clarifying their substance; and adding the language of “without excuse” to describe a Commissioner's allowable number of missed meetings as the basis for automatic removal. This ordinance also addresses the language and grammatical inconsistencies within these sections.

This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its passage, a written or printed copy having been available to the City Council and the public prior to the day of its passage.

This ordinance shall take effect and be in force on the thirtieth day from and after its final passage.

As a property owner, tenant or person who has requested notice, you should know that the Planning Commission will hold a public hearing to recommend approval, conditional approval, or denial to the City Council for adoption of the San Diego River Park Master Plan, Community Plan and Land Development Code Amendments for the 17.5 miles along the San Diego River. The San Diego River Park Master Plan serves as a policy document to guide design and development along the San Diego River. To implement the San Diego River Park Master Plan, amendments are proposed for Mission Valley, Navajo, Tierrasanta and East Elliot Community Plans and the Mission Valley Planned District Ordinance (Chapter 15, Article 14, Division 1), the Community Plan Implementation Overlay Zone (Chapter 13, Article 2, Division 14), the Mission Trails Design District (Chapter 13, Article 2, Division 12) and the Mission Trails Design District Manual.

The decision to approve, conditionally approve, modify or deny the proposed San Diego River Park Master Plan, Community Plan and Land Development Code Amendments will be made by the City Council at a future public hearing. You will also receive a notice of the City Council public hearing.
