AN ORDINANCE CALLING A SPECIAL RUN-OFF ELECTION IN COUNCIL
DISTRICT 4 IN THE CITY OF SAN DIEGO ON TUESDAY, MAY 21, 2013; AND CONSOLIDATING THE SPECIAL RUN-OFF ELECTION WITH THE CALIFORNIA STATE SPECIAL ELECTION TO BE HELD ON THE SAME DATE.

This Ordinance calls a Special Run-off Election in City Council District 4 in the City of San Diego to be held on Tuesday, May 21, 2013, for the purpose of electing a Councilmember for Council District 4, pursuant to the requirements of City Charter sections 10, 12 and 270(a). This Ordinance orders the consolidation of the Special Run-off Election with the California State Special Election to be held on May 21, 2013. The Ordinance provides that the precincts for the election shall be established by the Board of Supervisors and that the polls for the election shall be open from 7:00 a.m. until 8:00 p.m. on election day. The Ordinance also authorizes the Registrar of Voters of the County of San Diego to canvass returns of the Special Run-off Election. The Ordinance provides that the boundaries to be used for the Special Run-off Election to fill the vacancy in the District 4 office shall be the same as those used in the original election in 2010 for the current term, pursuant to San Diego Municipal Code section 27.0708.
This Ordinance contains a notice that a full reading of this Ordinance is dispensed with prior to its passage, a written or printed copy having been available to the City Council and the public a day prior to its passage.
Pursuant to Sections 275(c), 295(b) and 295(d) of the City Charter, this Ordinance relating to elections may be passed by the City Council on the date of introduction, which date shall be deemed the date of final passage.

PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following project:

An appeal has been received from Joshua Bruber, c/o Rory R. Wicks, Coast Law Group, regarding the Environmental Determination on a project involving an application for a Coastal Development Permit and Site Development Permit to construct an approximate 17,949 square foot, two-story, single family residence with a three car garage and swimming pool on a 66,256 square foot property.

The final decision by the City of San Diego on the project's Coastal Development Permit and Site Development Permit is appealable to the California Coastal Commission in accordance with Land Development Code Section 126.0710(a). Appeals to the Coastal Commission must be filed with the Coastal Commission at 7575 Metropolitan Drive, Suite 103, San Diego, CA 92108. Phone: (619) 767 2370. Appeals must be filed within 10 working days of the Coastal Commission receiving a notice of final action from the City. Please do not e-mail appeals as they will not be accepted. If you want to receive a Notice of Final Action, you must submit a written request to the City Project Manager listed above.

ZONE DESCRIPTIONS

Below are brief descriptions of the current and proposed permitted uses of the above property. Full and complete information should be obtained by referring to the appropriate Municipal Code Sections.

The project site is located at 9872 La Jolla Farms Road in the RS-1-2 Zone (for single family residential development), Coastal Overlay Zone (appealable), Coastal Height Limitation, Parking Impact, Residential Tandem Parking Overlay Zones and First Public Roadway, within the La Jolla Community Plan Area.

The decision of the City Council regarding the Environmental Determination is final.

Subject: SITE DEVELOPMENT PERMIT FOR ENVIRONMENTALLY SENSITIVE LANDS, CONDITIONAL USE PERMIT (CUP), AND VESTING TENTATIVE MAP (VTM) to allow for the restoration and enhancement of 875 feet of Chollas Creek, and the project also proposes the subdivision of land from three (3) parcels into four (4) parcels to allow for the development of commercial and multi-family residential apartment complex on 8.7-acre site. The project proposes three deviations to allow for parking rates consistent with the transit overlay zone, front yard setbacks, and wetland impact regulations which are described in further detail in the Initial Study Checklist. The project also proposes to underground existing and proposed utilities, Right-of-Way dedication, floodway flowage easement, and abandonment of some existing water service mains, and sewer laterals. The project is addressed at 4970 and 5050 Market Street and 504 and 602 Euclid Avenue between Market Street and Guymon Street, west of Euclid Avenue in the RM-3-9 and CC-3-5 zones within the Encanto Neighborhood of the Southeastern San Diego Community Planning Area, Southeastern San Diego Planned District Ordinance, Community Plan Implementing Overlay Zone A, Airport Influence Area, Very High Fire Hazard Severity Zone, Brush Zones, Outdoor Lighting Zones, Affordable Housing Parking Demand, Special Flood Hazard Zone Area, and Central Imperial Redevelopment Project Area. The project is also located in the Science Education Center Segment 2A of the Chollas Creek Enhancement Plan (Legal Description: Parcels 1 and 2 of PM 20520 and Lot 1 of Map 6281, APN 548-020-3500, 548-020-3600 and 548-010-1500).
The site is included on Government Code listing of hazardous waste sites.
