As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Process 3 Coastal Development Permit for the demolition of three existing residential units (duplex and a single family residence) and the construction of four (for rent) units in the form of two three-story duplexes, 5,093 square feet, on a 0.112 acre site. The proposed development will contain four (4) attached two-car garages (tandem parking) totaling 1,450 square feet, and the units range in size from 1,186 to 1,373 square feet. The project includes photovoltaic panels (solar panels) on the roof and will conform to the Council Policy 900-14 criteria by generating 50% or more of the projected total energy consumption on site through renewable energy resources (i.e. photovoltaic). AN ORDINANCE OF THE COUNCIL OF THE CITY OF SAN DIEGO AMENDING CHAPTER 5, ARTICLE 5, DIVISION 9, OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTION 55.0903, PERTAINING TO FIRE PROTECTION AND
PREVENTION.
The purpose of this ordinance is to amend the Municipal Code to extend the compliance date for fire sprinkler retrofits for high rise buildings from February 1, 2010 to January 31, 2011 and to require that the costs to provide active sprinklers on the twelfth floor of the City Administration Building be provided to the City Council during budget deliberations.
This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, since a written or printed copy will be available to the City Council and the public prior to the day of its passage.

REQUEST FOR RELEASE OF FUNDS

On or about May 26, 2010, the City of San Diego will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title 1 of the Housing and Community Development Act of 1974, as amended to undertake the following project:

SUBJECT: NORTH OCEAN BEACH GATEWAY. CITY COUNCIL APPROVAL AND REQUEST FOR RELEASE OF FUNDS (RROF) from CDBG funds in the amounts of $4,677.83 FY 2006, $25,000 from FY 2007, $50,000 from FY 2009 and $100,000 from FY 2010 from the 31st, 32nd, 34th and 35th Entitlement Program Years to allow for the demolition of existing building foundations and asphalt parking lot to allow for the construction of a decorative plaza and accessible pedestrian/bicycle entryway to Robb Field. The project has been designed to include walkways, a community wall with personalized tiles, coastal garden, site furnishings, art stands, bicycle racks, artistic railings, landscape and walkway lighting, and entry identification. The approximately 12,910-square-foot vacant project site is located at 2304 Sunset Cliffs Boulevard at the northwest corner of West Point Loma Boulevard in the Ocean Beach Community Planning Area and the Coastal Zone (Part of Lots 44 through 47, Block 29, Ocean Beach Park annex Map No. 1217). Project implementation also requires funding from private and public sources, such as but not limited to private donations, community Brick and Tile Sales, and State of California Proposition 40 grant funds. Pursuant to CEQA Guidelines Section 15072, the project site is not included on any Government Code Listing of hazardous waste sites. FINDING OF NO SIGNIFICANT IMPACT

The City of San Diego has determined that the project will have no significant impact on the environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. A Finding of No Significant Impact (FONSI) was prepared pursuant to NEPA and a Mitigated Negative Declaration (MND) was prepared pursuant to CEQA. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of San Diego, 1222 First Avenue, 5th Floor, San Diego, CA, 92101 and may be examined or copied weekdays from 8:00 a.m. to 4:00 p.m.

PUBLIC COMMENTS

ENVIRONMENTAL CERTIFICATION

The City of San Diego certifies to HUD that Beth Murray, in her official capacity as the Certifying Officer, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making, and action, and that these responsibilities have been satisfied. The legal effect of this certification is that upon its approval, the City of San Diego and HUD will have satisfied their responsibilities under NEPA and related laws and authorities, and allows the City of San Diego to utilize federal funds and implement the Program.

OBJECTIONS TO RELEASE OF FUNDS


HUD will accept objections to its release of funds and the City of San Diego certification for a period of fifteen days following the anticipated submission date (cited above) or HUD's actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of San Diego; (b) the City of San Diego has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds, or incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Section 58.76), and shall be addressed to HUD (Attn: Environmental Officer, Los Angeles Field Office, U.S. Department of Housing and Urban Development, 611 West 6th Street, Suite 800, Los Angeles, CA 90017. Potential objectors may contact HUD to verify the actual last day of the objection period.
