PLEASE ACCEPT THIS AS A NOTICE TO INFORM YOU, as a property owner, tenant or interested citizen, that the Council of The City of San Diego, California will conduct a public hearing, as part of a scheduled City Council meeting, on the following item:
The Regional Transportation Congestion Improvement Program (RTCIP) provides for the collection of a fee per new dwelling unit to ensure future development contributes its proportional share of the funding needed to pay for the Regional Arterial System (RAS) and related transportation and transit facility improvements, as defined in SANDAG's most recently adopted Regional Transportation Plan (RTP). This Council action is to approve a 2% increase to the fee as provided for in the TransNet Extension Ordinance. The report and relevant attachments are available for public inspection at the Office of the City Clerk, City Administration Building, 2nd Floor, 202 “C” Street, San Diego, California, 92101.
The decision of the City Council is Final.

Matter of the appeal by David Broide, from the decision by the Planning Commission approving an application for a Wireless Communication Facility (WCF) consisting of the removal of an existing 42' high monopole and the installation of a 47' high monopine with 30 directional antennas. The project also includes existing roof-top mounted microwave dish and an equipment shelter housing associated equipment. The project is located in the CN-1-2 zone at 3358 Governor Drive.
This project was determined to be categorically exempt from the California Environmental Quality Act on August 10, 2007 and the opportunity to appeal that determination ended August 31, 2007.

Process 5 Voluntary Accessibility Program Amendments to the Land Development Code and Local Coastal Program that would create an incentive program to encourage new residential development that incorporates accessible design features including accessible paths of travel, accessible entrances, and accessible common use rooms to meet the needs of as many users as possible. The proposal would amend Land Development Code Chapter 14, Article 5 to create a new Division 40.
The Voluntary Accessibility Program Amendments are intended to increase opportunities for persons with temporary, developing, or permanent disabilities to visit neighboring dwelling units, and to increase the number of accessible dwelling units in the local housing supply that meet long term housing needs by offering development incentives that facilitate this type of accessible design. The proposed program would apply only to those projects that voluntarily provide accessible design features beyond the minimum accessibility requirements of California Building Code Chapter 11A. The program would result in two main accessible design types: Tier I-Accessible Living Units and Tier II-Visitable Dwelling Units.
Tier I-Accessible Living Units would be required to comply with CBC Chapter 11A requirements in order to be eligible for incentives. These dwelling units would be adaptable to meet the accessibility needs of individual occupants thereby enabling those occupants to remain living in their homes during periods of temporary, developing, or permanent disabilities or frailties.
Tier II-Visit able Dwelling Units would be required to comply with a modified set of accessible design standards to create “visitable” units by facilitating access to, and access within, the primary level of a dwelling unit, which would include at a minimum a kitchen, a half bathroom, and at least one common use room in order to be eligible for incentives. These units would increase opportunities for persons with disabilities and frailties to visit neighboring dwelling units.
The incentives available to a project would be based on the number and type of dwelling units that would be voluntarily designed for accessibility. As proposed, the types of incentives available to eligible projects would include a floor area ratio bonus, density bonus, expedited processing, or a choice of development incentive from a set menu that includes parking related incentives such as reducing parking aisle width, reducing motorcycle facilities, reducing driveway width, allowing parking in a portion of the driveway within a required setback, or allowing tandem parking to count towards the parking requirement. Other types of development incentives include a reduction of the setback requirements, an increase in lot coverage, an increase in height specifically to accommodate an elevator or lift system, or a modification of the required landscape area.
On March 11, 2010 the Planning Commission voted 7-0 to recommend the City Council adopt the Voluntary Accessibility Program Amendments to the Land Development Code and Local Coastal Program.
The proposed amendments to the Land Development Code constitute an amendment to City of San Diego's Local Coastal Program (LCP) and must be certified by the California Coastal Commission to be effective in the Coastal Overlay Zone. The LCP amendment will not become effective until unconditionally certified by the California Coastal Commission.
