The San Diego Community College District will receive sealed Bids for the purchase of
Office / Instructional Supplies
Each bid shall be submitted on a form obtained from the Purchasing and Contract Services Department, 3375 Camino del Rio South, Room 270, San Diego, CA 92108; shall be sealed and deposited in said office on or before 3:00 PM, Thursday, May 26, 2005, and will be publicly opened and read aloud at that time and place.
The San Diego Community College District reserves the right to reject any or all bids, to accept or reject any one or more items of a bid, or to waive any irregularities or informalities in the bid or in the bidding.
No bidder may withdraw his bid for a period of ninety (90) days after the date and time set for the opening of bids.

In the Matter of Intention to Exchange Property
Owned by the The San Diego Community College District
With the San Diego Unified School District
(Former Beale Elementary School Site)
On motion of Member Senour, seconded by Member Grosch, the following Resolution is adopted:
WHEREAS, San Diego Community College District ("College District") desires to acquire the former Beale Elementary School site as part of its Master Development Plan to reconfigure Mesa College, and San Diego Unified School District ("School District") desires to construct a Middle College near Mesa College, and
WHEREAS, under Education Code section 81430 et seq., College District is authorized to exchange any of its real property which will not be needed for school classroom buildings for real property of the School District upon such terms and conditions as the parties thereto may agree;
NOW, THEREFORE, the Board of Trustees of the College District hereby resolves that it is the intent of this Board to convey real property in the City of San Diego, County of San Diego, State of California, belonging to the College District, and more particularly described as follows:
43,000 square feet of the College District property located southwest of the intersection of Armstrong Street and Armstrong Place. See Exhibit "A" for approximate proposed parcel site.
In exchange for above described real property together with approximately $13,465,899 (Thirteen Million Four Hundred and Sixty-Five Thousand and Eight Hundred and Ninety-Nine Dollars), School District will convey to College District approximately 8.13 acres and buildings, formerly the Beale Elementary School Site, 3390 Armstrong Street ("Beale Site"), more particularly described as:
That Portion of Pueblo Lot 1203 of the Pueblo Lands of San Diego, according to Map thereof made by James Pascoe in 1870, a copy of which said map is filed in the Office of the San Diego County Recorder November 14, 1921, and is known as Miscellaneous Map No. 36. Consisting of agreed square footage of 346,302.
BE IT FURTHER RESOLVED that said exchange of properties shall take place upon the approval of exchange by the Board of Trustees of the San Diego Unified School District, and subject to the following contingencies:
(a) Delivery of Deed for College District Property. College District to deliver to School District, in accordance with Government Code section 66428, subdivision (a)(2), a property description and deed conveying fee title to the College District Property consisting of 43,000 square feet; all costs for creation of said legal description and grant deed shall be borne by the College District.
(b) Completion of Phase 1 Environmental Site Assessment. Completion of a Phase 1 Environmental Site Assessment and Phase 2, if required, for both of the exchange properties, ensuring the environmental adequacy of each exchange property, such costs to be borne equally by both parties.
(c) CEQA. Completion and certification of required California Environmental Quality Act ("EQA") analysis, including certification of an environmental impact report ("EIR") or other appropriate document for school site acquisitions, if necessary. Community College has paid for CEQA analysis which addresses the conveyance of the School District property and the conveyance of the College District property.
(d) Title 5 Review. Approval by appropriate government entity of requirements of California Education Code Section 17521 and California Code of Regulations (CCR) Title 5, sections 140014-14012 for suitability of the College District Property as a school site ("Title 5 Review"). School District shall pay the costs of the Title Review.
(e) Education Code Section 81033 Submissions. Submission to appropriate governmental entities in accordance with requirements, if any, of California Education Code Section 81033, as applicable to the College District. College District shall pay the costs of all submissions for review, if any are required.
BE IT FURTHER RESOLVED that a final form of the Exchange Agreement between the parties shall be presented to this Board for review and approval after publication of this Resolution, and
BE IT FURTHER RESOLVED by the Board of Trustees of the College District that pursuant to Education Code Section 81432, and before the Board of Trustees approves the exchange of properties, this Resolution shall be published once a week for three weeks in a newspaper published in the District and having a general circulation therein.
PASSED AND ADOPTED by the unanimous vote of all the members of the board of Trustees of the San Diego Community College District this 14 day of 04/2005, by the following vote:
AYES: Members 5: Block, Grosch, Schwandt, Senour, Zschiesche.
