As a property owner, tenant, or person who has requested notice, please be advised that the Hearing Officer will hold a public hearing to approve, conditionally approve, or deny an application for a Coastal and Neighborhood Development Permit, Map Waiver and Waiver of Undergrounding to construct 717 square-feet of living area additions to an existing duplex, deck additions to all four of the existing units and convert the four residential dwelling units on-site to condominium ownership on a 9,375 square-foot, RM-1-1 zoned lot at 1443 Thomas Avenue within the boundaries of the Coastal Overlay Zone (non-appealable area), Coastal Height Limit, and the Pacific Beach Community Plan area.
Should the condominium conversion project be approved, tenants may be required to vacate the premises. No units may be sold in this building unless the conversion is approved by the city and until after a public report is issued by the Department of Real Estate. Each tenant has the exclusive right to contract for the purchase of his or her respective unit upon the same terms and conditions that such unit will be initially offered to the general public or terms more favorable to the tenant. The right shall run for a period of not less than 90 days from the date of issuance of the subdivision public report pursuant to Section 11018.2 of the Business and Professions Code, unless the tenant gives prior written notice of his or her intention not to exercise the right.

The decision of the Hearing Officer is final unless appealed to the Planning Commission. In order to appeal the decision you must be present at the public hearing and file a speaker slip concerning the application or have expressed interest by writing to the Hearing Officer before the close of the public hearing. To file an appeal to the Planning Commission contact staff at the Planning Department, 202 "C" Street, Fifth Floor, San Diego, California. The appeal must be made within 10 working days of the Hearing Officer's decision.
The certification of an Environmental Impact Report, adoption of a Mitigated Negative Declaration or Negative Declaration, or determination that the project is exempt from the California Environmental Quality may be appealed to the City Council after all other appeal rights have been exhausted. All such appeals must be filed by 5:00 PM within ten (10) business days from the date of the Planning Commission's certification/adoption of the environmental document. The proper forms are available from the City Clerk's Office, located on the second floor of the City Administration Building, 202 C Street, San Diego, CA 92101.
The decision made by the Planning Commission is the final decision by the City.
The final decision by the City of San Diego is not appealable to the California Coastal Commission.
If you wish to challenge the City's action on the above proceedings in court, you may be limited to addressing only those issues you or someone else have raised at the public hearing described in this notice, or written in correspondence to the City at or before the public hearing. AN ORDINANCE CALLING A SPECIAL MUNICIPAL ELECTION IN THE CITY OF SAN DIEGO, ON JULY 26, 2005, TO FILL MAYORAL VACANCY.
This Ordinance calls a Special Municipal Election in the City of San Diego on July 26, 2005, for the purpose of electing candidates to fill a vacancy in the office of the Mayor, pursuant to the requirements of City Charter section 24. The Ordinance also provides that the precincts for the election shall be established by the Board of Supervisors, and that the polls for the election shall be open from 7:00 a.m. until 8:00 p.m. on election day.
This Ordinance contains a notice that a full reading of this Ordinance is dispensed with prior to its final passage, since a written or printed copy will be available to the City Council and the public a day prior to its final passage.
This Ordinance relating to elections shall take effect on the date of its introduction and passage, pursuant to City Charter section 17.

A RESOLUTION REQUESTING THAT THE SAN DIEGO COUNTY REGISTRAR OF VOTERS CONDUCT A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SAN DIEGO ON JULY 26, 2005, TO FILL MAYORAL VACANCY.
WHEREAS, Section 24 of the Charter of the City of San Diego provides that in the event of a vacancy occurring in the office of the Mayor, existing by reason of any cause, the Council shall have authority to fill such vacancy, provided, however, that if the Council shall fail to fill such vacancy by appointment within thirty days after the vacancy, the Council must immediately cause an election to be held to fill such vacancy; and
WHEREAS, San Diego Municipal Code section 27.0705(a) provides that as soon as it is known that there will be a vacancy in the office of the Mayor, the presiding officer of the City Council shall, at the next regularly scheduled City Council meeting, or at a special meeting called for that purpose, consider the question of whether the vacancy shall be filled by appointment or special election; and
WHEREAS, on April 27, 2005, Mayor Dick Murphy submitted a letter of resignation effective July 15, 2005, and it is known that a vacancy will occur in the office of the Mayor; and
WHEREAS, at a meeting on May 2, 2005, the City Council considered whether to fill the vacancy by appointment or special election and adopted Ordinance No. O-19368 (N.S.), calling a Special Municipal Election in the City of San Diego on July 26, 2005, to fill the Mayoral vacancy; and
WHEREAS, it is desirable that the Registrar of Voters of the County of San Diego be authorized to conduct the Special Municipal Election and canvass the returns; NOW, THEREFORE,
BE IT RESOLVED, by the Council of the City of San Diego, as follows:
1. That the Registrar of Voters is hereby authorized to conduct the election and canvass the returns of the Special Municipal Election to be held on July 26, 2005, in the City of San Diego.
2. That the Registrar of Voters is requested to issue to all officers of the County charged with duties pertaining to the California State General Election appropriate instructions to take any and all steps necessary for the holding of the election.
3. That the Board of Supervisors of the County of San Diego is hereby requested to authorize and direct the Registrar of Voters of the County of San Diego to perform the following:
(a) Furnish a tabulation of the number of registered voters in each Coun cil district by precinct;
(b) Examine and verify the signatures on nominating petitions;
(c) Canvass the returns of the election, including absent voter ballots;
(d) Furnish a tabulation of the number of votes given in each precinct; and
(e) Furnish a tabulation of the number of votes given in each Council district by precinct.
4. That the City Clerk of the City of San Diego is hereby directed to file a certified copy of this resolution with the Board of Supervisors and Registrar of Voters of the County of San Diego.
BE IT FURTHER RESOLVED, that the City Auditor and Controller is authorized to reimburse the County of San Diego in full for the services performed by the Registrar of Voters for the City of San Diego in connection with the election services herein described, provided that the City Auditor and Comptroller first furnishes one or more certificates certifying that the funds necessary for expenditure are, or will be, on deposit with the City Treasurer.
BE IT FURTHER RESOLVED, that the City of San Diego agrees to indemnify and to save free and harmless the County, its officers, agents, and employees from expense or liability, including reasonable attorneyÕs fees, as the result of an election contest initiated pursuant to the California Elections Code sections 16000 through 16900.
