AN ORDINANCE AMENDING LEASE AGREEMENT BETWEEN THE SAN DIEGO UNIFIED PORT DISTRICT AND MARITIME MUSEUM ASSOCIATION
OF SAN DIEGO
 
  WHEREAS, the San Diego Unified Port District (District) and the Maritime Museum Association of San Diego, a California non-profit corporation, (Maritime Museum) are parties to a lease dated 7 September 2004 for the mooring of the vessels Star of India, Berkeley, Medea, Pilot and California, which vessels are to be open to the general public, and related uses; and
  WHEREAS, the Maritime Museum desires to add an additional vessel, the USS Dolphin, to its exhibit, which requires the consent of the District; and
  WHEREAS, the addition of said vessel also requires the approval of the United States Army Corps of Engineers (Army Corps), the United States Coast Guard (Coast Guard) and other regulatory agencies; and
  WHEREAS, mitigation for the additional water coverage area due to the permanence of the additional vessel may be required, and it is understood that the Maritime Museum plans to provide said mitigation measures at the Lovett Marsh, located east of South San Diego Bay, in the City of National City, NOW, THEREFORE,
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1. That lease agreement dated 7 September 2004 between the San
Diego Unified Port District and the Maritime Museum Association of San Diego, a California non-profit corporation,  is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No. 1, on file in the office of the District Clerk.
  Section 2. That the Board of Port Commissioners of the District hereby authorizes the Executive Director or his authorized representative to send a letter to the Maritime Museum stating that:
   a. The Maritime Museum will cooperate with the Army Corps, Coast Guard, and any other involved regulatory agency in order to obtain the approvals necessary to proceed with the addition of said vessel to its exhibit.
   b. In the event that the Maritime Museum does not satisfy the conditions of either the Army Corps, the Coast Guard or any other involved regulatory agency, by February 15, 2009, said Agreement for Amendment of Lease, Amendment No. 1, shall be null and void and of no further force or effect. 
  Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

AN ORDINANCE AMENDING LEASE AGREEMENT BETWEEN THE
SAN DIEGO UNIFIED PORT DISTRICT AND SOLAR TURBINES INCORPORATED
 
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1.  That lease agreement dated 22 December 1992 between the San Diego Unified Port District and Solar Turbines Incorporated, a Delaware corporation, is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No. 2, on file in the office of the District Clerk.
  Section 2.  This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

SAN DIEGO UNIFIED PORT DISTRICT AND DOLE FRESH FRUIT COMPANY
 
  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1.   That lease agreement dated 8 May 2001 between the San Diego Unified Port District and Dole Fresh Fruit Company, a Nevada corporation, is hereby amended in accordance with Agreement for Amendment of Lease, Amendment No. 3, on file in the office of the District Clerk.
  Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.

  The Board of Port Commissioners of the San Diego Unified Port District does ordain as follows:
  Section 1.   That lease agreement dated 9 October 1984 between the San Diego Unified Port District and Spinnaker Waterfront Hotel, LLC, a California limited liability company, (as successor in interest to Fifth Avenue Landing, LLC) is hereby amended in accordance with the Amended, Restated and Combined Lease, on file in the office of the District Clerk.
  Section 2.   This ordinance shall take effect on the 31st day from its passage by the Board of Port Commissioners.
