DIVISION 32 OF THE SAN DIEGO MUNICIPAL CODE BY AMENDING SECTIONS 22.3203, 22.3204, 22.3205, 22.3206, 22.3208, AND 22.3210, RELATING TO THE PURCHASING AGENT’S RESPONSIBILITIES AND THE PROCUREMENT
PROCESS TO BE USED BASED ON THE ESTIMATED AMOUNT OF THE
GOODS AND SERVICES CONTRACT.

This ordinance amends San Diego Municipal Code sections 22.0505, 22.3203, 22.3204, 22.3205, 22.3206, 22.3208, and 22.2310 thereof. The ordinance amends section 22.0505 of the San Diego Municipal Code to allow the Purchasing Agent, department head or designee to approve requisitions for goods in an amount not to exceed $25,000. All requisitions for goods in excess of $25,000 must be authorized by the Purchasing Agent.

The ordinance amends section 22.3203 relating to the procurement process to be used based on the estimated amount of the goods and services contract as follows: (1) for contracts greater than $25,000, but equal to or less than $50,000, the Purchasing Agent is required to seek competitive prices either orally or in writing; (2) for contracts greater than $50,000, but equal to or less than $150,000, the Purchasing Agent may award the contract but must solicit written price quotations from at least five potential sources; and (3) for contracts greater than $150,000, but equal to or less than $1,000,000, the Purchasing Agent may award the contract only after advertising for sealed bids or proposals for a minimum of one day in the City official newspaper at least ten days before bids or proposals are due.

Section 22.3204 is amended to prohibit the Purchasing Agent from subdividing two or more purchases of goods or services for an expenditure of $150,000 or more if the purpose is to avoid the bidding requirements of the San Diego Municipal Code and the City Charter.

This ordinance amends sections 22.3205 and 22.3206 to make non-substantive changes to conform the language and formatting.

The ordinance amends section 22.3208 to allow the Purchasing Agent to award contracts for $25,000 or less without advertisement or a competitive bidding process. Section 22.3208 is amended further to allow annual blanket purchases orders for expenditures greater than $25,000 without a competitive bidding process provided the expenditures are required by City forces for immediate completion of work in progress, not normally kept in City stores, and less $150,000.

Finally, section 22.3210 is amended to increase the threshold dollar amount that the Purchasing Agent is allowed to award contracts for services to any agency or non-profit without City Council approval. This ordinance amends the threshold dollar amount from $500,000 to $1,000,000 per fiscal year.

This ordinance shall take effect and be in force on the thirtieth day from and after its final passage.

This ordinance amends the Gaslamp Quarter Planned District Ordinance of the San Diego Municipal Code by amending sections 157.0103, 157.0104, 157.0201, 157.0202, 157.0203, 157.0204, 157.0205, 157.0305, 157.0401 and 157.0402 thereof to reflect the change in name of the Centre City Development Corporation (CCDC) to Civic San Diego. This ordinance also provides minor refinements and cleanup of the existing Gaslamp Quarter Planned District Ordinance.

This ordinance contains a notice that a full reading of this ordinance is dispensed with prior to its final passage, a written or printed copy having been available to the City Council and the public prior to the day of its passage.

This ordinance shall take effect and be in force on the thirtieth day from and after its final passage, except that those provisions of this ordinance that are applicable inside the Coastal Overlay Zone, which are subject to California Coastal Commission jurisdiction as a City of San Diego Local Coastal Program amendment, shall not take effect until the date the California Coastal Commission unconditionally certifies those provisions as a local coastal program amendment.

This ordinance amends the Marina Planned District Ordinance of the San Diego Municipal Code by amending sections 1511.0201, 1511.0202, 1511.0203, 1511.0204, 1511.0302, 1511.0401 and 1511.0402 thereof, to reflect the change in name of the Centre City Development Corporation (CCDC) to Civic San Diego. This ordinance amends the Centre City Planned District Ordinance of the San Diego Municipal Code (CCPDO) by amending sections 156.0302, 156.0303, 156.0304, 156.0305, 156.0306, 156.0307, 156.0308, 156.0309, 156.0310, 156.0311, 156.0313, 156.0314, and 156.0315, and Figures B, C and D thereof. This ordinance amends the CCPDO to: (1) require that planned development permit developments be consistent with the Downtown Design Guidelines; (2) allow Neighborhood Center, Main Street, and Commercial Street Alternative Interim Uses to include non-active commercial uses in certain circumstances for a limited term; (3) lower the Process Level for sidewalk cafes from a Process Two Neighborhood Use Permit (NUP) to by right as a limited use; (4) require a CUP for Assembly and Entertainment uses that provide live entertainment; (5) increase pet open space requirements for certain developments; (6) permit waiver of overhead screening requirements for small condenser units; (7) lower the Process Level for outdoor activities from a CUP to a NUP unless live entertainment is proposed more than six times a year; (8) permit accessory acoustic music by right at bona-fide eating establishments and with a NUP for non-bona-fide eating establishments; (9) permit on-site alcohol sales at non-bona-fide eating establishments with a NUP; (10) permit off-site alcohol sales by right for brewpubs as a limited use, with a NUP for brewpub tasting rooms, and with a CUP for brewery tasting rooms; and (11) establish downtown as a low-parking demand area for calculating affordable housing development parking demand requirements. This ordinance also amends the CCPDO to make mapping corrections and non-substantive changes to conform the formatting to current, standard San Diego Municipal Code conventions.
