Notice is hereby given that Mark Christopher Cooley, Executor of the Estate of Love Magness, will sell at private sale to the highest and best offer, on or after May 11, 2012 at 12707 High Bluff Drive, Suite 100, San Diego, CA 92130, the following real property of the estate: all right, title and interest of said decedent at the time of death and all right title and interest in the estate additionally acquired in 5028 E. Mountain View Drive, San Diego, California, 92116, described as: EXHIBIT "A"
The South Thirty-seven and one half (37ˆ) feet of the North Seventy-five (75) feet of Lot Thirteen (13) measured along the West line of said Lot, in Block Five (5) of Normal Heights according to Map thereof #985, filed in the office of the Recorder of said San Diego County May 9, 1906. The North and South boundary lines of said Property being parallel with the North line of said Lot Thirteen (13) - ALSO - Lot thirteen (13), Block five (5), excepting the North Seventy-five (75) feet in Normal Heights. Also described as Assessor's Parcel No. 440-102-16-00.
The terms and conditions of sale are: 1. Down payment subject to Executor's approval. 2. Purchase price due in cash or cash equivalent in lawful money of the United States or part cash and balance upon such terms and conditions as are agreeable to the Executor. 3. Close of escrow within 30 days, or other time period agreeable to Executor. 4. Property sold "as is", without condition, representation, warranty or covenant of any kind, express or implied. No termite clearance is given. No personal property is included. 5. Seller to pay commission from proceeds of sale to the listing broker and purchaser's broker in the sum of five percent (5%) divided equally between them. 6. Buyer and Seller will split the escrow fees equally and subject to normal prorates.
Offers for this property must be made in writing and directed to the Executor, in care of Stephen E. Hurst, at the address, 12707 High Bluff Drive, Suite 100, San Diego, CA 92130. Offers will be received at the aforesaid office at any time after the first publication hereof and before date of sale.
The Executor reserves the right to reject any and all offers. Offers need not be considered unless they substantially comply with the terms of this notice.
